ORDINANCE NO. 772
AN ORDINANCE OF THE CITY OF
NATIONAL CITY, CALIFORNIA,
PROVIDING FOR THE REGU-
LATION OF BURNING RUBBISH
AND DEBRIS.
The City Council of the City of
National City, California, does ordain,
as follows:
SECTION I. The burning of rub-
bish, trash, debris, grass, weeds,
brush, building, or debris from any
wrecked building, or any kind is pro-
hibited within the corporate limits
of the City of National City except
in accordance with the following reg-
ulations:
(a) No person shall set fire to or
cause or procure fire to be set to
any rubbish, trash, debris, grass,
weeds, brush, inflammable mater-
ial on any street, alley, court,
yard, vacant lot or any other
space unless a written permit so
to do shall first have been secured
from the Fire Marshal or his dep-
uties, and in strict accordance
with the terms of the permit. The
Fire Marshal and his deputies
shall include in such permits such
safeguarding restrictions or pre-
cautions as may be reasonably
necessary to prevent damage to
life, or property or prevent the
commission of a nuisance and
shall have the power to refuse, re-
voke or postpone permits when
necessary for the protection of
life and property.
(b) Having secured a permit to do
any burning mentioned in this or-
dinance shall not relieve any per-
son doing such burning from re-
sponsibility for damage to prop-
erty of another which may occur
as a result of such burning.
(c) Any fire, regardless of whether
a permit has been obtained for
same or not, must be extinguished
when so ordered by the Fire Mar-
shal, or his deputies, and it shall
be a violation of this ordinanee
for any person to refuse to com-
ply with any such order.
(d) Some adult person must be in
constant attendance when inflam-
mable material mentioned in this
ordinance is being burned and it
shall be unlawful to leave any fire
mentioned in this ordinance unat-
tended.
(e) Care must be taken when burn-
ing to guard against any nuisance
from excessive smoke, offensive
odors, and flying ashes and cin-
ders.
SECTION 2. Any accumulation of
combustible or inflammable material,
boxes, broken wood, trash, waste pa-
pers, rags, or other debris of any
kind whatsoever back of fences or
signboards, or in or near buildings,
stairways, cellars, basements, or any
other location, which is located so as
to be liable to cause fire, is hereby
prohibited, and it shall be unlawful
to place or allow any such material
named in this section to remain in
such location named herein.
SECTION 3. Cotton batting, dry
vines, leaves, trees, celluloid or oth-
er highly inflammable materials shall
not be used for decoration purposes
in show windows or stores without a
permit, provided, however, that noth-
ing in this section shall be held to
prohibit the display of saleable goods
permitted and offered for sale in the
store. None of the above material,
nor paper or cloth not used as wall
paper or surfacing shall be used in
dance halls, night clubs, auditoriums,
or places of assembly unless suitably
treated to make them flame -proof.
Electric light bulbs in stores or pub-
lic halls shall not be decorated with
paper or other combustible materials
unless materials shall first have been
rendered flameproof.
SECTION 4. Any person, firm or
corporation violating any of the pro-
visions of this ordinance shall be
deemed guilty of a misdemeanor and
upon ,,onviction thereof shall be pun-
ished by a fine of not more than
$500.00, or by imprisonment in the
City or County Jail for a period of
not more than six months, or by
both such fine and imprisonment.
SECTION 5. This ordinance shall
take effect and be in foi ce on the
thirty first day from and after its
pzssage.
SECTION 6. The City Clerk is
hereby directed to publish this ordi-
nance on,.e in the National City
News, a newspaper of weealy circu-
lation, printed and published in the
City of National City, California.

City Council of the City of National
City, California, this 1st day of No-
vember, 1949, by the following vote,
to -wit:
AYES: Councilmen Adams, Curry,
Matthews, Thatcher, Fritz.
NAYS: Councilmen None.
ABSENT, None.
