ORDINANCE NO. 673
AN ORDINANCE AMENDING
SECTION 304 OF ORDINANCE
656 OF THE CITY OF NATION-
AL CITY, CALIFORNIA.
The City Council of the City of
National City, California, DOES
ORDAIN as follows:
SEC. 1. Section 304 of Or-
dinance 656 of the ordinances of
the City of National City, Cali-
fornia, is hereby amended to read
as follows:
Section 304:
In order to determine the suit-
ability of alternate materials and
construction and to provide for
reasonable interpretations of the
provisions of this Code, there
shall be and is hereby created a
Board of Examiners and Appeals,
consisting of five members, who
are qualified by experience and
training to pass upon matters
pertaining to building construc-
tion. One member shall be the City
Attorney of the City of National
City, one shall be the City Engi-
neer of the City of National City,
one a member of the Planning
Commission of the City of Nation-
al City and two shall be licensed
general contractors licensed by the
State of California. The Building
Inspector shall be an ex-officio
member and shall act as secretary
to the Board. The Board of Exam-
iners and Appeals shall be ap-
pointed by the Mayor and shall
hold office at his pleasure. The
Board shall adopt reasonable
rules and regulations for con-
ducting its investigations and shall
render all decisions and findings
in writing to the Building Inspec-
tor with a duplicate copy to the
appellant and may recommend to
the City Council such new legis-
lation as is consistent therewith.
The Board of Examiners and
Appeals may interpret the provi-
sions of this Code to cover a spe-
cial case, if it appears that the
provisions of this Code do not
definitely cover the point raised
or that a manifest injustice might
be done, provided that every such
decision shall be by unanimous
vote of the Board of Examiners
and Appeals. Decisions as to the
use of alternate materials and/or
types of construction shall be by
majority vote and if not permitted
by this Code shall become effec-
tive only when authorized by an
amendment to this Code.
SEC. 2. The City Clerk is
hereby directed to publish this
Ordinance once in the National
City News, a newspaper of gen-
eral circulation published in the
City of National City, California.
PASSED AND ADOPTED by
the City Council of the City of
National City, California, this 2nd
day of April, 1940, by the follow-
ing vote, to -wit:
AYES: Councilmen Cording-
ly, Kilerease, Thatcher, Warner,
Bird.
NAYS: Councilmen none.
ABSENT none.
