ORDINANCE NO. 675
AN ORDINANCE REGULATING
THE KEEPING OF DOGS IN THE
CITY OF NATIONAL CITY,
CALIFORNIA.
The City Council of the City of
National City, California, does or-
dain:
Section 1—For the purpose of
this Ordinance the word "dog"
is defined to be any male or fe-
male dog of the age of Six (6)
weeks or over.
Section 2—It shall be unlaw-
ful for any person owning, hav-
ing an interest in, harboring or
having the care, charge, custody,
control or possession of a dog to
suffer, allow or permit such dog
to go upon the public streets, al-
leys, parks and public places in
the City of National City, unless
such dog is on a leash and is in
the custody of some competent
person.
Section 3—Every dog found
within the corporate limits of said
City of National City, in violation
of this Ordinance shall be im-
pounded, be or caused to be im-
pounded by the Chief of Police
of said City, who is hereby de-
clared to be ex officio Pound Mas-
ter, or other officer designated to
do said work of Pound Master,
and if every such impounded dog
be not claimed and taken away by
the owner within Three (3) Days
from the date of said impound-
ment and all costs and charges
hereinafter named on keeping
such dog pounded, it shall be the
duty of the Pound Master or other
officer so designated to kill or
cause to be killed such dog within
Seven (7) Days after the expira-
tion of the aforesaid redemption
period.
In lieu of killing any dog pur-
suant to the provisions of this
Ordinance, the Chief of Police or
Pound Master or other officer so
designated may dispose of said
dog by public or private sale for
not less than the costs and charges
of impoundment and maintenance
by the said City; provided, that
said dog shall not be sold prior
to the Three (3) Day period of
redemption hereinabove set forth.
All moneys received from re-
demptions and sales of dogs im-
pounded shall be forthwith paid
by the Chief of Police into the
Treasury of said City.
For keeping dogs so impounded
under this Ordinance there shall
be charged the following costs:
One Dollar ($1.0Q) for im-
pounding a dog; and Twenty-
five Cents (25c) for each day
that said dog is held by said
City under this Ordinance.
In the event that any one dog
is impounded more than once
within a period of two (2) months,
there shall be charged for said
impoundment Three Dollars
($3.00) for the second impound-
ment within said period of two
months, and Five Dollars ($5.00)
for the third and each subsequent
time during said two months'
period.
Section 4—It shall be the duty
of any and all persons owning or
harboring dogs in the City of Na-
tional City to keep the same in
such manner that the peace and
quiet of the neighborhood and
traveling public shall not be dis-
turbed.
Section 5—It shall be the duty
of the Chief of Police or Pound
Master or other officer so desig-
nated to impound or cause to be
impounded any dog found within
the corporate limits of said City
in violation of any of the provi-
sions of this Ordinance.
Section 6—It shall be unlawful
for any person owning, having
an interest in, harboring, or hav-
ing the care, charge, custody,
control or possession of a dog to
suffer, allow or permit such dog
to trespass upon any private
property in the City of National
City, or to suffer or permit said
dog to enter upon, be or remain
upon any private property in said
City without the consent of the
owner thereof.
Section 7---The Chief of Police
or Pound Master shall make a
monthly report of the number of
dogs impounded, redeemed, sold,
killed or otherwise disposed of,
together with a record of receipts
and disbursements, and file the
same with the City Clerk of said
City.
Section 8—Any person violating
any of the terms and provisions
of this Ordinance shall be deemed
guilty of a misdemeanor and, up-
on conviction thereof shall be
fined in a sum not exceeding Fifty
Dollars ($50.00), or by imprison-
ment in the City Jail of said City,
or the County Jail of the County
of San Diego, for a period not
exceeding Ten Days (10) or by
both such fine and imprisonment.
Section 9---The City Clerk of
the City of National City is here-
by directed to publish this Ordi-
nance once in the National City
News, a newspaper of general cir-
culation in the City of National
City.
Section 10—This Ordinance
shall be in full force and effect,
Thirty-one (31) Days after its
final passage.

the City Council of the City of
National City, California, this
21st day of May, 1940, by the
following vote, to -wit:
AYES: Councilmen Cordingly,
Kilcrease, Thatcher, Warner.
NAYS:Councilmen none.
ABSENT: Bird.
