ORDINANCE NO. C78
AN ORDINANCE REGULATING
THE USE OF BICYCLES IN THE
CITY OF NATIONAL CITY
CALIFORNIA
The City Council of the City of
National City does ordain as fol-
lows:
Section 1—It is hereby declared to
be a misdemeanor for any person to
violate any of the terms or provisions
of this ordinance, or to use a bicycle
in and upon any street, alley, park
or other public place in the City of
National City or upon any path or
lane set aside for the exclusive use
of bicycles within said City, without
complying in all respects with the
terms and provisions of this Ordinance.
Section 2—It is hereby declared to
be a misdemeanor for any parent or
guardian of any child or of anyone
who has the custody and control of
any child in the City of National
City to knowingly permit such child
to use a bicycle in the City of Na-
tional City in violation of the terms
and provisions of this Ordinance.
Section 3—A "bicycle," within the
meaning of this Ordinance, is hereby
defined to be every mechanical device
propelled by human power upon which
a person may ride, which has two
tandem wheels over nineteen (19)
inches in diameter, designed to oper-
ate with safety tires on said wheels.
Section 4--It shall be unlawful for
any person to operate or use a bicycle
upon any of the streets, alleys, or
highways in the City of National
City, propelled wholly or in part by
muscular power without first obtain-
ing from the Police Department a li-
cense therefor.
Section 5—The Police Department
is hereby authorized and directed to
issue upon written application, bi-
cycle licenses which shall be effective
from the 1st day of January, 1941,
to and including December 31, 1941, and
thereafter said licenses shall be issued
for the calendar year, commencing
on the first day of January of each
said calendar year and ending on the
thirty-first day of December of each
said calendar year. Said licenses when
issued shall entitle the licensee to
operate such bicycle for whieh said
license has been issued, upon all the
streets, alleys and public highways,
exclusive of the sidewalks thereof, in
the City of National City. Said li-
censes shall be good for the calendar
year in which the , said licenses are
issued.
Section 3—The City of National City
shall provide each year metallic li-
cense plates and seals, together with
registration cards, said licenses plates
and registration cards having num-
bers stamped thereon in numerical
order, beginning with Number 1, a.nd
indicating the year for which the
same are issued, and the letters
NCBL stamped thereon; said metallic
license plates shall be suitable for
attachment upon the frames of bi-
cycles, and it shall be the duty of the
Police Department to attach one such
metallic license plate to the frame of
the bicycle and to issue correspond-
ing registration card to the licensee
upon payment of the license fee herein
provided for. S'uch metallic license
plate shall remain attached during the
existence of such license. The Pollee
Department shall also keep a record
of the date of issue of each license,
to whom issued, and the number
thereof.
Section 7---The annual license fee
to be paid for each bicycle shall be
50c and shall be paid in advance and
said license may be transferred when
the ownership of such bicycle is trans-
ferred, in accordance with the terms
of this Ordinance, and a fee of 50c
shall be paid for the registration of
such transfer. All license fees col-
lected under this Ordinance shall be
paid into the General Fund of the
City of National City.
Section 8—It shall be the duty of
every person who sells or transfers
ownership of any bicycle_, to report
such sale or transfer by returning to
the Police Department the registra-
tion card issued to such person as li-
censee thereof. together with ,the
name and address of the person to
whom said bicycle was sold or trans-
ferred, and such report shall be made
within five days of the date of said
sale or transfer. It shall be the duty
of the purchaser or transferee of such
bicycle to apply for a transfer of regis-
tration therefor within five days of
said sale or transfer.
Section 9—Every person engaged in
the business of buying or selling of
new or secondhand bicycles in the
City of National City shall file with
the Chief of Police a monthly report,
giving the name and address of the
person from whom or to whom a bi-
cycle is purchased or sold, the des-
cription thereof, the frame number
thereof, and the number of the license
plate, if any, attached to said bi-
cycle.
Section 10—It shall be unlawful for
any person to ride a bicycle upon a
sidewalk within any business or resi-
dential district of the City of National
City, provided, that the City Council
may, by resolution duly adopted,
authorize the riding of bicycles on
the sidewalks of such residen'ial dis-
tricts or areas with such limitations
as to hours and specific purposes as
they may deem proper.
Section 11---The Chief of Police of
the City of National City shall also
have authority, in the event that any
juvenile or person under the age of
twenty-one (21) years is found violat-
ing any provision of this Ordinance,
to take and impound the bicycle of
such juvenile or minor so found vio-
lating such Ordinance, and to hold
the same for a period not to exceed
Thirty (30) Days, during which said
time the Chief of Police shall notify
the parents or guardian or other per -
sun having the custody and control
of said juvenile or minor of such of-
fense, and secure, 1f possible, the co-
operation a.nd assistance of such par-
ent or guardian or other person hav-
ing the custody and control of such
juvenile or minor, in preventing the
recurrence of such offense by such ju-
venile or minor.
Section 12—Every person convicted
of a violation of any provisions of
this Ordinance shall be guilty of a
misdemeanor and shall be punished
by a fine of not more than Fifty
($50.00) Dollars or by imprisonment
in the County Jail for not more than
ten (10) days, or by removal or sus-
pension of the license to operate a
bicycle within said City for a period
not to exceed thirty (30) days, or by
impounding the bicycle of the person
convicted for a period not to exceed
Thirty Days (30), or by any or all of
said penalties or any combination
thereof.
Section 13—All ordinances or parts
of ordinances in conflict herewith are
hereby repealed.
Section 14—This Ordinance shall be
in full force and effect. on January 1,
1941, and in no event less than thirty
(30) days from and after its final
passage.

City, California, this 17th day of Dec.,
1940, by the following vote, to -wit:

Kilcrease, Warner, Thatcher.
NAYS: Councilmen none.
