AN ORDINANCE REPEALING OR-
DINANCES NO. 461, 963, AND 405;
REGULATING AND LICENSING
TAXICABS, AUTOMOBILES FOR
HIRE, SIGHTSEEING CARS EN-
GAGED IN THE BUSINESS OF
TRANSPORTING PA S SE NG ERS
FOR HIRE UPON PUBLIC STREETS
OF THE CITY OF NATIONAL
CITY, CALIFORNIA, AND OTHER
VEHICLES FOR HIRE, REQUIR-
ING PERMITS THEREFOR, AUTH-
ORIZING THE TRAFFIC COMMIS-
SION OF THE CI'SY OF NATIONAL
CITY, TO GRANT OR DENY AP-
PLICATION FOR PERMITS TO
OPERATE SUCH VEHICLES, AND
PROVIDING PENALTIES FOR VIO-
LATIONS OF THE TERMS OF
THIS ORDINANCE.
RF, IT ORDAINED by the Council
of the City of National City,
California, as follows:
SECTION 1: That Ordinances No.
461, 463 and 465, and all Ordinances
or parts of Ordinances in conflict
therewith, be, and the same are here-
by repealed.
SECTION 2: "Vehicles for hire"
shall include taxicabs. automobiles for
hire, sightseeing automobiles and all
other vehicles transporting passen-
gers over the public streets of the City
of National City. California, not
operating over a definite route.
SECTION 3: It shall be unlawful to
operate any vehicle for hire in the
city limits of the City of National City,
California, without a permit so to
do. Each vehicle so operating shall
have a permit posted in a conspicuous
place in the drivers compartment of
said vehicle. The charge for such
permit shall be Twenty-five ($25.00)
Dollars per calendar year. or frac-
tion thereof, payable in advance.
SECTION 3A; All taxicabs must
have and conform to a color scheme.
approved by the Traffic Commission.
The Traffic Commission shall require
applicants for permits to furnish such
information as to the Traffic Com-
mission deems proper as a basis for
consideration of apnlications, (orders
approved by the City Council), and
the responsibilities and qualifications
of persons applying therefore, the
nature of the business they wish to
conduct, the number. condition, ca-
pacity. description and safety of the
vehicles intended to he operated. as
well as distinguishing marks .r paint
upon such vehicles, shall be included
in the information required to he
given by applicants. The 7 raffle
Commission may refuse a permit to
any applicant whose responsibilities,
qualifications, or methods of operat-
ing its business does not comply with
the standards and requirements as
determined by the Traffic Commission.
SECTION 4: No permit shall be is-
sued to any driver, operator or own-
er within the meaning of this Ordi-
nance who is under the age of 21
years or is not a citizen of the United
States.
SECTION 5: The number of ve-
hicles for hire authorized to operate
in the City of National City and for
which permits may be issued shall
be based upon the population of the
city, being determined on the ratio
of one such vehicle for each 2.000 in-
habitants reported in the preceding
T'nited States Government Census,
except that if the Traffic Commission
finds that the public convenience a
necessity, require the granting of ad-
ditional permits (after a hearing) it
shall recommend the granting of the
same to the City Council.
SECTION 6: It shall be unlawful
to operate any vehicle for hire within
the meaning of this Ordinance unless
there is on file with the City Clerk
of the City of National City, a policy
of insurance executed and delivered
by a company authorized to carry on
any insurance business in the State
of California.. by the terms of which
said company assumes responsibility
of injury to any'.,. person or property
caused by the operation of said ve-
hicle in the following .amounts, to -wit:
35000,00 property damage;
$5000.00 for death or injuries to
any one person in any one accident;
$10,000.00, for death or injuries to
two or more persons in any one acci-
dent;
Provided. however, that no policy
of insurance issued by any mutual or
reciprocal company as defined by
G-encral Laws shall be accepted by the
City of National City, California.
SECTION 7: The Traffic Commis-
sion of the City of National City, Cali-
fornia, is hereby authorized, in its
discretion, to make and adopt such
rules and regulations in addition to
those specifically mentioned herein as
are consistent with the carrying out
of this Ordinance and as are in its
judgment and discretion necessary and
proper for safety in the operation of
vehicles regulated by this Ordinance,
such rules must be approved by the
City Council of the City of National
by Resolution. The Traffic Commis-
sion, in its discretion, shall have
power to grant, deny, revoke, or sus-
pend at any time all permits and
licenses mentioned in this Ordinance.
a.nd it shall also have the power to
have with -drawn from service all ve-
hicles for hire not in good safe con-
dition and clean in appearance.
Any action taken or order issued by
the Traffic Commission shall be final
unless an appeal is taken in writing,
within 10 days, to the Council of the
City of National City, California, by
filing in writing the same at the office
of the City Clerk of the City of Na-
tional City, California.
SECTION 8: Any person, firm or
corporation violating any of the pro-
visions of this Ordinance shall be
deemed guilty of a misdemeanor, and
upon conviction, thereof, shall be
punished by forfeiture of his permit
and by a fine not exceeding Five
Hundred and 00/100 ($500.00) Dol-
lars, or by such forfeiture and im-
prisonment in the City Jail for not
more than six (0) months, or by both
such forfeiture, fine and imprison-
ment.
SECTION 9: If any section, sub-
section, sentence, clause or phrase of
this Ordinance if for any reason held
to be unconstitutional, or otherwise
invalid by any Court of competent
jurisdiction, such decision shall not
affect the validity of the remaining
portions hereof.
SECTION 10: This Ordinance shall
take effect and be in force on the
thirty-first day from and after its
passage and approval.

City Council of the City of National
City, California, this 15th day of
July. 1941, by the following vote.
