AN ORDINANCE REPEALING OR-
DINANCE NO. 628 OF THE CITY
OF NATIONAL CITY, "ENTITLED
AN ORDINANCE OF THE CITY OF
NATIONAL CITY, CALIFORNIA,
REGULATING THE INSTALLA-
TION OF SEWER LATERALS" AND
REPEALING ALL ORDINANCES
AMENDING ORDINANCE NO. 628
AND ALL OTHER ORDINANCES
AND PARTS OF ORDINANCES IN
CONFLICT THEREWITH A N D
PROVIDING FOR THE REGULA-
TION OF THE INSTALLATION OF
SEWER LATERALS IN THE CITY

THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY DOES ORDATN
AS FOLLOWS:
SECTION 1. Ordinance No. 686,
entitled "An Ordinance Repealing Or-
dinance No. 628 of the City of Na-
tional City, California, regulating the
Installation of Sewer Laterals" and
repealing all ordinances amending
Ordinance No. 628 and all other ordi-
nances and parts of ordinances in
conflict therewith and providing for
the regulation and the installation of
sewer laterals in the City of National
City, California.
SECTION 2. It shall be unlawful for
any person other than the City of
National City, its officers, agents and
/or employees to connect any pipe,
drain or sewer with or to open or
penetrate any pubiic sewer in the
City of National City or to injure,
remove or open any portion of any
manhole, flush tank, lamp hole, in-
spection pipe or any other part of
or appurtenance to arty public sewer.
A11 sewer laterals from mains to
the property line shall be constructed
and the connections made by the City
of National City under the provisions
of 1.1.is Ordinance and under the su-
pervision of the Superintendent of
Streets of said City.
SECTION 3. That in addition to
any fee for a permit or other charge
which the City may make for con-
necting with the public sewer, the
owner of any property to be served
or the person making the application
for such conection, where the con-
duit is no larger than four inches
(4") inside diameter, or where the
length of the lateral is not more than
fire feet greater than half the width
of the street or alley, shall pay to the
City of National City for the work
of constructing and laying laterals
the sum of Tnirty-Eight ($38.00) dol-
lars, together with the regular permit
charge of and in the sum of Two
($2.0Q) dollars.
Where a conduit larger than four
inches (4") inside diameter is used,
an additional charge equal to the
excess of the cost of the four inch
(4") conduit shall be made.
For deep sewer laterals, an extra
charge shall be made equal to the
cost of the excavation and baekfill in
excess of eight feet (8') in depth.
In case a connection is made to a
public sewer where the service lat-
eral is already installed to the prop-
erty line, the property owner shall
install the pipe to the property line
and uncover the existing sewer so
that a connection can be made at
such property line, which connection
shall be nrade by the City of National
City, in such case a. charge of Three
($:3.00) dollars, in addition to the
permit fee, shall be made for mak-
ing such connection.
Whenever an unusual condition ex-
ists, so it is necessary to make a di-
agonal run of over forty-five feet
(45') for a street sewer lateral, or
more than fifteen feet (15') for an al -
Icy sewer lateral to reach the center-
line of such street or alley, an esti-
mate of the cost for any work in ex-
cess of the foregoing mentioned dis-
tances will be furnished by the City
Engineer and the amount specified
in such estimate shall be deposited
with the Superintendent of Streets at
the time the permit Is taken out for
such work.
Where property owners exca-
vate outside of the property lines and
into the streets for basement pur-
poses and desire connections with pub-
lic sewers across such excavation,
they shall install the necessary soil
pipe at their own expense to the out-
side line of such excavation from
which point to the public sewer, the
City of National City will make the
required installation.
SECTION 4. Every house or build-
ing shall be separately and indepen-
dently connected with the public sew-
ers, except in cases where there may
be a house in the rear of the bit. In
such case it may be connected with
the sewer of the house in front, pro-
vided the existing sewer is of suffi-
cient capacity and the property is
owned by the same parties.
Whenever a sewer line is to be in-
stalled at the cost of the property
owners on or across any street, alley
or any ground dedicated to the City
for street or other purposes, or across
private property, and where said
sewer is to be connected with the
public sewers, or may become a part
of the public sewer system, the same
shall be installed under the supervi-
sion of the Superintendent of Streets
and the City shall have the right to
make extensions and connections there-
to at any and all times. Before any
lateral connections are made thereto
at any such sewer, so installed by
property owners, a permit therefor
must be taken out and the regular
fee paid therefor.
SECTION 5. Every soil pipe or pri-
vate drain, laid within the property
lines which is to be connected with
the public sewers, shall be of cast
iron. The grade and alignment of any
such pipe shall meet with the ap-
proval of the City Council, except
that matters pertaining to plumb-
ing shall be governed by the Ordi-
nances of said City relating to plumb-
ing, and shall be subject to inspec-
tion and approval by the City Plumb-
ing Inspectors. No connection what-
soever shall be rnade between sew-
ers on private property and the pub-
lic sewers until the City Plumbing In-
spector. No connection whatsoever
snail be made between sewers on
private property and the public sew-
ers until the City Plumbing Inspector
has approved the same and issued a
certificate of approval thereof.
SECTION 6. The words "public
sewers" shall mean and include any
and all publicly owned pipe lines,
manholes, lamp poles, inspection
holes, 2leanouts, septic tanks, cess-
pools, accessories, equipment or a.p-
purtcnances to any and all devices
used for the disposal of the sewage
of the City of National City whether
within or without the boundary lines
of private property.
SECTION 7. Whenever it is neces-
sary for the City to relieve stop -ups
in laterals, if the obstruction is in the
street between the sewer main and
the property line, and is due to waste
matter which shou.d not have been
placed in the sewer, the owner of
such property shall pay to the City
of National City the cost of the re-
moval of such obstruction; and it is
hereby declared to be unlawful for
any person to put into any sewer,
fixture or pipe connected therewith,
any insoluble ina.terixl, garbage,
wood, or metallic substance.
SECTION 8. No connection to the
public sewers shall be made, or any
work done thereon, either in the pub-
lic streets or alleys, or within prop-
erty lines, until a. permit for such con-
struction and work has been issued
therefor by the City. Permits for
sewer connection shall be issued only
to persons who have plumbing al-
ready installed in their premises, or
have taken out permits therefor un-
der the provisions of Ordinance No.
503. Applications for permits re-
quired by the provisions of this ordi-
nance, shall be made to the Super-
intendent of Streets.
The Superintendent of Streets shall
collect the following fees for per-
mits issued under the provisions of
this ordinance:
(a) For a connection with public
sewers the sum of $2.00
(b) For the installation of a sep-
tic tank or cesspool located en pri-
vate property, the sum of $.50 for a
permit and $1..00 for inspection.
SECTION 9. Any money collected by
the Superintendent of Streets under
the provisions of this ordinance shall
be paid forthwith to the City Treas-
urer and credited to the General
Fund of the City of National City.
Upon the receipt of an application
for a permit under the provisions of
this ordinance, the Superintendent of
Streets shall, if the same is in ac-
cord with the provisions hereof, is-
sue a perrnit to the owners of the
property to he served, in triplicate,
one copy to be delivered to the per-
rnillee, one copy to be kept in his
office and one copy to be delivered
to the City Engineer.
SECTION 10. Upon the issuance of
a permit under the provisions of this
ordinance, the Superintendent of
streets shall proceed with the work
called for by the permit, and complete
the same without delay, and upon
completion shall file with the City En-
gineer, a copy of that permit with a
notation thereon that the work has
been completed and the connection
made and the date of completion, to-
gether with an itemized statement
of the cost thereof.
SECTION 11. It shall be the duty of
the Superintendent of Streets to keep
on file all records of sewer permits
issued. It shall be the duty of the
City Engineer to plat sewer lines
constructed hereunder on the plats
in his office. He shall, when neces-
sary or requested by the Superintend-
ent of Streets, lay out on the ground
and stake the same, any work call-
ed for by any permit issued hereun-
der. The Superintendent of Streets
however shall have general super-
vision of the work, and all work done
here -under must be done to his satis-
faction.
SECTION 12. A11 public sewers con-
structed and conduits leading thereto
installed under the provisions of this
ordinance shall be left uncovered
until the Superintendent of Streets
has given permission to cover the
same.
SECTION 13. Where an application
is made for a connection to a public
sewer where a service lateral has al-
ready been installed to the curb line
only, the City shall extend the service
lateral to the property line, and the
owner of the property to which the
lateral is extended, or the person
making the application for such con-
nection, shall pay to the City of
National City for the work of con-
structing and extending such lateral
the sum of Fourteen Dollars ($14.00),
together with the regular permit
charge in the sum of Two Dollars
($2.00).
SECTION 14. No building can be
connected to the City sower until
all fixtures shall have been propertly
trapped and vented. An inspection
fee of Two Dollars ($2.00) will be
required for sewer connections and
building to determine sanitary con-
dition of plumbing. All buildings
within any sewer district must be
connected to the City sewer within
one year after completion of said
City sewer.
SECTION 1a. Any person who shall
violate any of the provisions of this
ordinance shall be deemed guilty of
a misdemeanor and upon conviction
thereof shall be punished by a fine
of not more than Three Hundred
Dollars ($300.00) or by imprisonment
in the City or County Jail for a per-
iod not exceeding three months, or
by both such fine and imprisonment.
Any plumber who shall be con-
victed of a violation of this ordinance
shall forfeit any license that may
have been granted him as a plumber
within said City and he shall not re-
ceive another license as a plumber
except upon the vote of the City
Council granting the same to him.
SECTION 16. Ail ordinances and
parts of ordinances in conflict here-
with are hereby repealed.
SECTION 17. This ordinance shall
take effect and be in force on the
thirty-first day from and after the
date of its final passage.
SECTION 18. The City Council
shall certify to the passage of this
ordinance, said ordinance shall be
published once in the National City
News, a weekly newspaper of gener-
al circulation printed and published
in the City of National City, Califor-
nia.
