ORDINANCE NO. 662
AN ORDINANCE, PROVIDING
FOR THE CONTROL ANI)
ERADICATION OF RABIES
AND '1'IIF: RTINNING AT
LARGE OF DOGS IN THE
CITY OF NATIONAL CiTY,
CALIFORNIA.
The City Council of the City of
National City, California, DOES
ORDAIN as follows:
SECTION 1: For the purpose
of this ordinance, the word "Dog"
is defined to be "Any male or fe-
male dog of the age of six months
or Over."
SECTION 2: Tt shall be unlaw-
ful for any person owning, having
an interest in, harboring or hav-
ing the care, charge, custody, con-
trol or possession of a dog to suf-
fer, tallow or permit such dog to
go upon the public streets, alleys,
parks, and public places in the City
of National City, California, un-
less such dog has been vaccinated
wish canine rabies vaccine —one
injection or other approved method
within a period of twelve (12)
months. and is officially tagged as
provided in Section 3 hereof.
SECTION 3: Said vaccinations
shall be performed at the expense
of the owner, by the Health Of-
ficer or any duly qualified and
licensed physician or veterinary.
The persons vaccinating said dog
shall issue certificates of vaccina-
tion, which certificate of vaccina-
tion or a ce•itified copy thereof
shall he registered with the City
('lerk of the City of National City,
California, who shall thereupon
issue an official vaccination tag,
which shall be securely fastened to
a collar or harness, which collar or
harness at all times be wo"n by
cosh vaccinated dog. It shall he un-
lawful to attach an official vaccin-
ation tag to any dog unless the
arse has been duly vaccinated as
herein provided.
SECTION •1: It shall be unlaw-
ful for any person owning, having
an interest in, harboring or having
the care, charge, control, custody
or possession of any dog, to suffer,
allow, or permit such dog, to enter
any restaurant. grocery store, milk
depot, fruit or vegetable market,
meat market. or any other place of
business in the City of National
City, California, where food or
foodstuffs of any character used
for human consumption is manu-
factured, sold, served or handled.
Si?CTION 5: It shall he unlaw-
ful for any person owning, having
an interest in, harboring or having,
the care, charge, custody, control
nr possession of any ring within
the City Limits of the City of Na-
tional City, California, which has
not hccn vaccinated with canine
rabies vaccine within a period of
twelve (12) months and which is
not officially tagged, as provided
in Section 3 hereof, to permit or
allow such dog to come into con-
tact with the general public in any
manner. or to go free or run at
large upon the public streets, al-
leys, parks and public places in the
City of National City, California,
whether such dog 1S wearing a
muzzle or is on a leash, or is in the
custody of any person, or in any
manner; provided, however, that
any such person owning or having
an interest in any dog which has
rot been vaccinated may obtain
from the Chief of Police of the
City of National City, California,
or the Health Officer a permit to
transport such dog for the purpose
of having such dog vaccinated. or
to remove such dog from the City
of National City, California, but
for no other purpose.
SECTION 6: For the purpose of
this ORDINANCE, the term "Gen-
eral Public" shall not include any
person or pe"•sons upon the private
premises of the owner or custodian
of any dog ur dogs who is upon
said private premises at the in-
stance and request of said owner
or custodian.
SI•)CTiON 7: If any ring shall
bite any person or animal within
the City of National City, Calif-
ornia, the owner or person having
control of such dog shall, upon re-
quest of the Health Officer or any
peace officer, deliver such dog to
such Officer to be isolated for ten
(10) days, for the purpose of de-
termining whether or not such dog
is afflicted with rabies, and the
owner or person having control of
such dog shall pay all the expens-
es of the keeping of such dog dur-
rug the time the dog shall he so
isolated.
SECTION S: Whenever the
owner or person having the cue•
tody of an animal shall observe or
learn such animal has shown
symptoms of rabies, or is acting
in a manner which would lead to
the belief that such animal might
have rabies, such owner or person
having the custody or possession
of such animal, shall immediately
notify the Health Officer or Chief
of Pollee, and such person shall
allow the Health Officer or any
Peace Officer of the City of Na-
tional City, California, to make
an inspection or examination of
such animal until it shall be estab-
lished to the satisfaction of the
Health Officer that such animal
has or has not the rahics.
SECTION 9: Whenever any ani-
mal shall he bitten by any other
animal having rabies, the owner
or person having the custody, pos-
session or control of the animal so
bitten shall, upon being informed
thereof, either kill such animal or
quarantine it and keep it tied up
for a period of six (6) months,
and the 'Health Officer or the Chief
of Police or other Peace Officer of
the City of National City, Calif-
ornia, shall have the power to kill
or destroy or quarantine the an-
imal so bitten in case the owner ot•
person having the custody, control
or possession thereof shall fail to
do so immediately, or in the event
the owner or person having the
care, custody or control of such
animal is not readily assessable.
SECTION 10: Any person vio-
lating any of the provisions of this
Ordinance shall be deemed guilty
of a misdemeanor and upon con-
viction thereof shall be punished
by a fine not exceeding Fifty
($50.00) Dollars, or by imprison-
ment in the City Jail of said
City of National City, California,
or county jail of the county of
San Diego, California, for a
period of not more than ten
(10) days, or by both such fine and
imprisonment.
SECTION 11: All proper of-
ficials of the City of National City,
California, are hereby authorized
to examine and enter upon all pri-
vate premises for the enforcement
of this Ordinance.
SECTION 12: Tt appearing that
there is an epidemic of rabies
throughout. the State of California,
County of San Diego and within
the City Limits of the City of Na-
tional City, California, it is here-
hy directed necessarily for the pre-
servation of the public health and
safety that this Ordinance go into
effect immediately upon its adop-
tion and one publication in the Na-
tional City News, a newspaper of
(r^neral circulation in the City of
National City, California.
SECTION 1:3: If any word,
phrase, clause, or section of this
Ordinance shall be held unconsti-
tutional, such decision shall not
affect the validity of any other
word, phrase, clause, or Section of
this Ordinance.
SECTION 11: The City Clerk is
hereby directed to publish this Or-
dinance ogee in the National City
Netts a newspaper of general ci'•-
colution in the City of National
City, California.

Gty Council of the City of Na-
tional (lily, California, this 5th day
of July, 1938, by the following
vote, to -wit:
