0PDINANCE NO. 556:
AN ORDINANCE DEFINING ASSAULT AND BATTERY
AND FIXING A PENALTY THEREFOR.
The Board of Trustees of the City of National
California, do ordain ai follows:
SECTION 1. Any person who hail, within the corporate
limits of the City of National City, California, unlawfully
attempt, coupled with a present ability, to commit a violent
injury on the person of another, shall be deemed guilty of
an aasault.
SECTION 2. Any person who ehall, within the corporate
limitof the City of National City, California, willfully and
unlawfully WM force or Vielome upon the person of another,
shall be deemed guilty of a battery.
SECTION 3. Any person found guilty of violating any
of the provisions of this Ordinance shall be fined in any
eum not to exceed One HuWred Dollars (8100.00) or be im-
prieoned in the jail of said City or in the jail of the
County of an Diego, State of California, for not more than
ninety (90) daye, or both, at the discretion of the Court,
and in cae of a fine only, if the mute hall not be paid,
the peroon so convicted and fined shall be imprisoned in
the jail of said City or in the jail of said County until
said fine Is satisfied at the zate of Two and no/100 Dollars
($2.00) for ach day of imprisonment.
SECTION 4. The Clerk of said City is hereby direoted
to cause this. Ordinance to be pUblished onoin The Natlonal
City News, a newspaper printed and published in said City,

SECTION 5. This Ordinance shall be in force and
on the 31et day after itsp ,wage and approval.
