HomeMy WebLinkAboutCC ORD 1928-578 Animal slaughtering (Repealed by 1366)124. 578 ORDiNANC NO AN ORUENANCE REGULATING THE SLAUGHTERING OF ANIMALS AND PROVIDING INSPECTION oF ANIMALS SLAUGHTERED FOR MEAT OR HEAT FOOD PRODUCTs; PROVIDING FOR THE INSPECTION OF EsTAELIsHMENTs WHERE MEATs AND MEAT PRODUCTS ARE SOLD FOR RUYAN CONSUMPTION; PROVIDING FOR THE FORFEITURE OF MEATs THAT ARE uNFIT FOR HUMAN Poop AND PRESCRIBING THE DUTIES OF QFFIOIAL8 AND PERSONS TO ENFORCE THE PROVISIONS OP THIS ORDINANCE AND PROVIDING A PENALTY FOR THE VIOLA- TIONS OP THE PROVISIONS OF THI$ ORDINANCE. INSPECTION OF W AT AND MEAT FOOD PRODUCTS: The Board of Trustees of the City of Natioual Qtty, California, do ordain as follows* Section 1. It shall be unlawful for •any person or persons, firm or corporation, to conduct maintain or operate an establishment for the slaughtering of animals or for the preparation of meat or meat food products within the city limits of the City of National City, without first having obtained a permit therefor from the• Board of Health of the City of National City. Section 2. Every applicant for such permit shall file with the Health Department of the City of National City a written application *bleb shall state the name and Address of the applican a description of the property, its location, street and number, wherein and whereon it is proposed to conduct such establishment and. such other information as the Board of Health of the City of National City by regulation may require. Section 3, Every person, firm or corporation applying for a permit under the provisions of this ordinance *hall at the time of making ePplication for such permit pay an annual inspection fee of 01040 ( ten dollars) to the clerk or employee of the Health Department designated to receive such fees. All moneys received as inspection fees under the provisions of this ordinance shall be paid into the City Treasury and placed in the Health Fund. A permit for which application is made under the provisions of this ordinance may be granted at any time during the year, but 125. all permits granted hereunder, shall expire an the 31st day of Deeember of the year in which the same are granted. Motion 4. Upon receipt of suoh application it shell be the duty of the Health Officer or an authorised representative of the Health Department, to investigate the existing conditions in the place mentioned in the application, and if it shall avear that the existing conditions comply with the provisions of this ordinance as to sanitation of buildings, drainage, sewage, cleanliness, equipment, utensils, employees, water eupply, disposal of refuse, etc, and conforms with the rules and regulations of the Board of Health of said City, the rules and regulations of the State Board of Health, the rules and regulations of the Division •of Animal Industry State of California, and the laws of the State of Calif- ornia as prescribed in Agriculture Statutes of the State of Calif- ornia regulating slaughter houses era meat inspection (chapter 732, Statutes 1921), the provisions of said laws, rules and regulations, and any amendments thereto are by this reference adopted as a part of this ordinance, a permit therefor shall be granted only upon the express condition however, that it shall be revocable upon a conviction of the person or persons holding •a permit for the violation of any of the provisions of this ordinenee• Section 6. The Board of Health is hereby empowered to designate certain places where slaughtering establishments may be maintained, and if conditions so warrant cause to be established centralized slaughtering plants where all slaughtering shall be done. Section 6. It shall be unlawful for any person or persons, firm or corporation, or the agent or employee o•f any person or persons, firm or corporation, to sell or exchange for other thing of value within the City of National City any meat or meat food products for human consumption unless such meat or meat food products shall have first been inspected by an agent of the Board of Health of the City of National City, and shall bear the stamps 2. 126. Each licensed establishment shall be designated by a serial number which shall be stamped on all earaasses and parts of carcasses from such eatablisherntns which are passed by the health Department for human food. This number shall be a part of and shall be included in the stamp, "San Diego County Inspected and Pasted'as provided for tn. this ordinances. Section 7. The Board of Health shalt provide for ante-morttem and post-mortem veterinary inspection of all animals slaughterer in establishments for which permits have been issued, and for the inspection of carcasses or parts of carcasses and of food products during the time of preparation, transportation and storage as provided for in Section 5 of this ordinance. All slaughtering and preparation of meat or meet food products shall be conducted on week days between the hours of 7:00 A. M. and 6e00 «, in the presesee of an authorized agent or representative of s aid Health Department. The Health Department may at its discretion designate certain days for the slaughtering of animals at the various abbateirs, and in cases of emergency a special permit to slaughter may be issued in writing for the slaughter of animals at suchhours as may be necessary to meet such emergency; provided that such slaughtering shall be conducted in a manner as shall comply with the provisions of this ordinance regulating the inspection for the slaughtering of animals. Section ii. Whenever it shall appear to the satisfa4tion of the Meat Inspector that any meat or meat food products may be unfit for human food or any carcasses or parts of carcasses may be sold or offered for sale contrary to the provisions of this ordinance„ such meat or meat food products or carcasses or parts thereof shall be subject to confiscation by the Health Department 127. or Its agent, or subjeeted to such treatment as shall satisfy said agent that such meat or meat food produets or careasses or parts thereof, cannot be sold for human food. The Health Department may prepare for use on meats or meat food products not intended for use as human food a special stamp setting forth the nature of such product* MEAT MANXETSt Section 9. It shell bo unlawful for any per firm or corporation to establish, maintain, or conduct any meat market or place where meat -or meat food products are sold within the City of National City, without first having obtained a permit from the Board of Health to do so. Section 10* EVery applicant for such permit shall file with' the Health Department of the City of National City a written appll cation which shall state the name and addreas of the applicant, a description of the property, its location, street and number, wherein and whereon it is proposed to conduct such establishment or business, and such other information as the •Health Department of the City of National City by regulation may require. Every person, firm or corporation applying for a permit under the proviaions of this ordinance shall at the time of making application for such permit pay an annual inspection fee of $8.00-- (five dollars) to the clerk or employee of the Health Department of said City designated to receive slush fees* All moneys received as inspection fees under the provisions of this ordinance shall be paid into the City Treasury and placed in the Beelth Fund. A permit for which application is made under the provisions of •this ordinance may be granted at any all permits granted hereunder, shall of December of the year in which the time during the year, but expire on the Slat day same are granted» Section 11. The Board of Health is herby authorized to provide inspection for all places where meat or meat food products 120. are prepared or sold for food. The owner, proprietor or manager of every meat market or place where meat or meat food produets are prepared or sold shall keep posted in a conspicuous place in his place of business a copy of the rules and regulations of the Board of Health of the City of National City regulating t marketsmand the permit granted to him under the provisions of this ordinance. Section 12. A person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor AnA pon conviction thereof shall be punished by a fine of not les than Ten Dollars (*1000) nor more than Three Hundred Dolls (000.00) or by imprisonment in the County Jail of the County o San Diego for a period of not more than three month (3) or both such fine and imprisonment. Svery person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a separate offense for each day during such or any portion of which, such violation continues, and shall be punished therefor as herein provided. Section 13. The City Clerk is hereby directed to cause this Ordinance to be published once in The National City News, a news- paper printed and published in said City, and of general circulation therein. Section 14. This Ordinance shall take effectotfect and be in force - on the thirty-first day after its final passage.
