AND 3 OF OHWIIINANCE NO. 583 OF THE CITY OF NATIONAL CITY, CALIFORNIA, ENTITLE? "AN ORDINANCE REGULATING RESTAURANTS, LUNCH COULTERS, CAFES, CAFETE?IAS, SODA FOUNTAINS, FRUIT STANDS, GROCERIES, AND OTHER PLACES IN THE CITY OF NATIONAL CITY, CALIFORNIA, WHEME FOOD IS PREPARE FOR SALE, SOLD, DISTRIBUTED, OR DI3. PLAYED FOR SALE, AND PROVIDING FOR THE REGULATION OF ALL PERSONS HANDLING FOOD STUFrS." The Board of Trustees of the City of National City, California, do ordain as follows:" SECTION 1. That Section 2 of Ordinance No. 583 of the City of National City, California, entitled An Ordinance Regulating Restaurants,, Lunch Countess, Cafes, Cafeterias, Soda Fountains, Fruit Stands, Groceries, and other Places in the City of National. City, California, where Food is Prepared for sale, Sold, Distributed, or Displayed for. Sale, and Provid- ing for the Regulation of all PpisrtS Handling .Food Stuffs'," be and the same is hereby amended to read as follows. Every applicant for such permit shall file with the Health Department of the City of National City a written appli. cation which shall state the name and address of the applicant, a description of the property wherein or whereon it is proposed to conduct such establishments as are designated in Section One, also the character of business which is proposed to be conducted, and such other information as the Health Department of the City of National City by regulation may require. A permit, for which application is made, under the provisions of this ordinance, may be granted at any time during the year, but all permits granted hereunder shall expire on the 31st day of December of the year in which the same are granted. SECTION 2. That Section 3 of said Ordinance be and the same is hereby amended to read as follows: 148. Upon the filing of fah application, it shad be the duty of the Health Officer or any authorized employee of the Health Department of the City of National City, to investi.ga the matter set forth in such application, and the sanitary conditions in and about the place wherein and whereon it is proposed to conduct the business designated in the application and if it shall appear to the satisfaction of the Health Depart- ment that such place conforms to the requirements of this ord- inance and is a proper and suitable place for such business, a permit shall be granted only on the express condition that it shall be subject to revocation or suspension by said Health Department upon the conviction of the holder of such permit, hie employee, servant or agent, or any other person acting with his consent or under his authority for the violation of any of the provisions of this ordinance, and provided further that such permit shall be transferable only, upon application to the Health Department and with its consent. SECTION 3. The City Clerk is hereby directed to cause this Ordinance to be published once in The National City News, a newspaper printed and published in said City, and of general, circulation therein. SECTION 4. This Ordinance shall take effect and be in force on the thirty-first day after its final passage.
