The City Council of the City of National City, California, does ordain as follows SECTION 1. Ordinance No. 1716 and Chapter 15.16 of the Municipal Code of the city are hereby repealed and replaced to read as follows: 15.16.002 Finding and declaration. The City Council specifi- cally and expressly finds and declares _that the nature and uniqueness of the climate, terrain, location, environment, and rate of population growth of the city necessitates and demands specific changes in, and variations from, the Uniform Housing Code, 1982 Edition, which are noted in and made a part of this chapter. (Ord. 1716 1, 1980: Ord. '15 8 1, 1977). 1. 1. 010 Code ado. ted. There is adopted by the City Council, for the purpose of prescribing regulations governing hazards to life and property from substandard (residential) housing conditions, that certain code known as the Uniform Housing Code, as copyrighted by the International Conference of Building Officials, being particularly the 1982 edition, save and except such portions as are hereinafter deleted, modified or amended, of which code not fewer than three copies have been and are now on file in the office of the city clerk; and the sane are adopted and incorporated as fully as.if set out at length herein. and from the date on which the ordinance codified herein takes, effect, the provisions thereof shall be controlling within the limits of the city. Section 201(a) of the Uniform Housing Code adopted by this chaster is amended to read as follows: " ection 01(a) AUTHHORI TY. The San Diego County Health Depart- ment is designated as the a ,ency responsible for issuing housing per- mits. collecting fees therefor. and making all housing inspections pursuant to this code. (Ord. 1747 3, 1981). 15. 1 .030 --Section 01(b .. delete. Section 201(b) of the Uniform Housing Code adopted by this chapter is deleted. (Ord. 1423 4, 1974). 15.16.040 Section 203 arnend__Ad isor and Appeals Board. Sec - Lion 203 of the Uniform Housing Code adopted by this chapter is amended to read as follows: "Section 203. ADVISORY AND APPEALS BOARD. The Advisory and Appeals Board, established by, City Ordinance No. 134, shall provide reasonable interpretations of the provisions of this code and shall hear appeals as provided for in said City OrdinancewNo. 1324." (Ord. 1423 5, 1974). 1 .1 .050 Section 304 add --Annual permit. A new Section 304 is added to the Uniform Housing Code adopted by this chapter to read as follows: "Section 304. ANNUAL HOUSING PERMIT. (a) It shall be unlawful for any person, firm, partnership, or corporation either for himself or itself to own or operate an apartment house, hotel, or lodging house as defined in Chapter 4 of this code without first obtaining . an annual Housing Permit therefor. b) The annual Housing Permit required by this section shall be prorated on a quarterly basis and shall expire by limitation on Decem- ber 31st of the year in which it is issued. The annual Housing Permit shall not be transferable from one establishment to another; however, the permittee for an annual lousing Permit may be changed without charge upon notification to the Department of Building and Safety." (Ord. 1588 , 1977; Ord. 1423 6, 1974). 15.16.0 0 Section 308 add --Fee schedule. A new Section 30S is added to the Uniform housing Code adopted by this chapter to read as follows: "(a) All fees for housing permits and housing permit inspections shall be set by resolution of the City Council and shall be in accor- dance with the San Diego County fee schedule then In effect. The City 'Council may, from time to tine, consider amendments to the adopted fee schedule to maintain that accordance, which amendments may be made by tz j resolution of the City Council." (Ord. 1747 7, 1981: Ord. 1629 () , 1 1978; Ord. 1423 7, 1974). (hi 1fo2s i o f perms t feces . Annual housing permit fees shall be 1 1 billed and collected by the San Diego County Health Department." (Ord. 1747 4, 1961). 15.16.070 Section 306 add --Permit SUS cnsion or revocation. A new Section 306 is added to the code adopted by this ordinance codified herein to read as follows: "Section 306. SuSPENSION AND REVOCATION OF HOUSING PERMIT. Whenever it is found that any apartment house or hotel is not being conducted in con- formity with the provisions of this code, the annual Housing Permit to oper- ate same shall be subject'to suspension or revocation by the Director of Building and Safety. (Ord. 1423 8, 1974). 15.16.060 Section 401 amend -}Health officer defined. Section 401 of the code adopted by the ordinance codified herein is amended by changing a definition to read as follows: "HEALTH OFFICER. Health Officer, as used in this Code, shall be the County Health Officer." (Ord. 1747 6, 1961; Ord. 1423 9, 1974). 15. 1 .090 Section 401 amend --I partners and lvd in hawse defined. Section 401 of the code adopted by the ordinance codified herein is amended by adding definitions to read as follows: "APARTRENT HOUSE is any building, or portion thereof, which is designed, built, rented, leased, let or hired out to be occupied, or which is occupied as the home or residence of three or more families living independently of each other and doing their own cooking in the said building, and _shall include flats and apartments. HOTEL is any building containing six or more guest rooms intended or • designed to be used, or which are used, rented or hired out to be occupied, or which are occupied for sleeping purposes by guests. LODGING HOUSE is any building or portion thereof, containing not more than five guest rooms which are used by not more than five gueFts where rent is paid in money, goods, labor or otherwise. A lodging house shall comply with all the requirements of this Code for dwellings_" (Ord. 1423 10, 1974). 15.16. 100 Section S03 amend -Floor nrc. required. Section 503 of the code adopted by the ordinance codified herein is amended by adding paragraph (d) to read as follows: "(d) SPECIAL PROVISION. *acre more than two persons occupy a room used for sleeping purposes the required floor area shall be increased at the rate of SO square feet for each occupant in excess of two." (Ord. 1423 , 1974). 15.16.040 Section 203 amend --Advisory and Appeals Board. Sec- tion 203 of the Uniform Housing Code adopted by this chapter is amended • t T. to read as follows: • "Section 203. The City Council may, from time to time, consider amendments to the adopted fee schedule to 'maintain that accordance, which amendments may be made by resolution of the City Council."
