HomeMy WebLinkAboutCC RESO 15,876RESOLUTION NO. 15876 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AFFIRMING THE DECISION OF THE CHIEF OF POLICE TO PERMANENTLY SUSPEND THE PAWNBROKER'S LICENSE OF RAMON ELIZONDO WHEREAS, on or about December 28, 1988, the Chief of Police of the City of National City provided written notice to RAMON ELIZONDO that his pawnbroker's license was permanently suspended pursuant to Section 6.54.060 of the National City Municipal Code; and WHEREAS, RAMON ELIZONDO filed an appeal of the suspension of his pawnbroker's license with the National City City Council; and WHEREAS, on February 7, 1989, in the City Council Chambers, City Hall, 1243 National City Blvd., National City, the City Council held a hearing to consider the appeal of RAMON ELIZONDO from the suspension of his pawnbroker's license; and WHEREAS, at said hearing, the City Council considered oral and documentary evidence, and deliberated upon said matter in public session. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the City Council makes the following findings: 1. On or about March, 1988, RAMON ELIZONDO received stolen property, namely, a gold watch taken during a robbery in Sheldon, Iowa, which was pawned in RAMON ELIZONDO's place of business. Based on this incident, RAMON ELIZONDO was in violation of Penal Code Section 496.1 (Possession of Stolen Property), Business and Professions Code Section 21641 (Not in Possession of State Secondhand Dealer's License), and National City Municipal Code Section 6.54.010 (No Pawnbroker's License). 2. After said incident, National City police detectives advised RAMON ELIZONDO of the aforementioned violations, and advised him to cease and desist from further illegal activity. 3. On or about April, 1988, RAMON ELIZONDO received stolen property, namely, jewelry taken during a series of residential burglaries. Based on this incident, RAMON ELIZONDO was in violation of Penal Code Section 496.1, Business and Professions Code Section 21641, and National City Municipal Code Section 6.54.010. 1 4. On or about April, 1988, RAMON ELIZONDO pleaded guilty to violation of Section 6.54.010 of the National City Municipal Code. 5. RAMON ELIZONDO has violated Chapter 6.54 of the National City Municipal Code, regulating pawnbrokers. 6. RAMON ELIZONDO has conducted a pawnbroker's business in an unlawful manner. BE IT FURTHER RESOLVED that the decision of the Chief of Police to permanently suspend the pawnbroker's license of RAMON ELIZONDO is affirmed, and that the appeal of RAMON ELIZONDO from said suspension is denied. BE IT FURTHER RESOLVED that the time period during which judicial review of this decision must be sought is governed by Code of Civil Procedure Section 1094.6.
