HomeMy WebLinkAboutCC RESO 15,878RESOLUTION NO. 15,878 RESOLUTION OF NECESSITY TO ACQUIRE REAL PROPERTY BY E'IINENT DOMAIN FOR _MUNICIPAL PURPOSES (2408 EAST 18TH STREET OWNED BY E.E. & E. HANGEN) (A.P.N. 558-230-02) BE IT RESOLVED by the City Council of the City of N&tional City as follows: SECTION 1: The public interest convenience and necessity of the City of National City and the inhabitants thereof require the construction, maintenance and operation of Euclid Avenue from 16th to 20th Streets located in the City of National City, County of San Diego, State of California. SECTION 2: At their meeting of February 14, 1989, the City Council of the City of National City considered the necessity of the acquisition of fee title to a portion of the real property and improvements located at 2408 East 18th Street by eminent domain proceedings, for purposes of the construction of Euclid Avenue from Toth to 20th Streets. SECTION 3: The public interest and necessity require said project and require the acquisition of said real property in fee, and the project and acquisition are for a public use. SECTION 4: The taking of said real property for municipal purposes by eminent domain proceedings is authorized by Government sections 37350, 37350.5, 37351, 37353 and 40404. SECTION 5: The proposed project is planned and located in a manner which will be compatible with the greatest public good and the least private injury. SECTION 6: The offer required by section 7267.2 of the Government Code has been made to the owner or owners of record. SECTION 7: The City Attorney is hereby authorized and directed to commence and maintain in the name of the City of National City such actions and proceedings of eminent domain in the Superior Court of California, County of San Diego, as are necessary to acquire in fee, for the purpose and uses aforesaid, a portion of that certain real property commonly known as 2408 East 18th Street, which is situated in the County of San Diego, and within the City of National City, State of California, more particularly described hereto as EXHIBIT "A". Hangen and Eustolia Hangen recorded January 18, 1984 as instrument No. 84-019519, Official Records of the County of San Diego, State of California, described as follows: Beginning at the northwesterly corner of said Hangen parcel, thence along the northerly line of said parcel, North 72°05'50" East, 20.58 feet to a point of cusp with a curve concave southeasterly, having a radius of 20.00 feet; thence leaving said northerly line, southwesterly along said curve, through a central angle of 90°00'00", an arc length of 31.42 feet; thence South 17°54'10" East, 97.96 feet to a point on a tangent curve concave westerly having a radius of 2042.00 feet; thence along said curve through a central angle of 1°22'02", an arc length of 48.73 feet to a point on the westerly line of said Hangen parcel; thence nontangent to said curve, along said westerly line, North 17°54'10" West, 166.68 feet to the point of beginning.
