HomeMy WebLinkAboutCC RESO 15,879RESOLUTION NO, 15,879 RESOLUTION OF NECESSITY TO ACQUIRE REAL PROPERTY BY EMINENT DOMAIN FOR MUNICIPAL PURPOSES (2415 EAST 2OTH STREET OWNED BY W.S. & F. DESMOND) (A.P.N. 558-240-08) BE IT RESOLVED by the City Council of the City of National City as follows: SECTION 1: The public interest convenience and necessity of the City of National City and the inhabitants thereof require the construction, maintenance and operation of Euclid Avenue from 16th to 20th Streets located in the City of National City, County of San Diego, State of California. SECTION 2: At their meeting of February 14, 1989, the City Council of the City of National City considered the necessity of the acquisition of fee title to a portion of the real property and improvements located at 2415 East 20th Street by eminent domain proceedings, for purposes of the construction of Euclid. Avenue from 16th to 20th Streets. SECTION 3: The public interest and necessity require said project and require the acquisition of said real property in fee, and the project and acquisition are for a public use. SECTION 4: The taking of said real property for municipal purposes by eminent domain proceedings is authorized by Government sections 37350, 37350.5, 37351, 37353 and 40404. SECTION 5: The proposed project is planned and located in a manner which will be compatible with the greatest public good and the least private injury. SECTION 6: The offer required by section 7267.2 of the Government Code has been made to the owner or owners of record. SECTION 7: The City Attorney is hereby authorized and directed to commence and maintain in the name of the City of National City such actions and proceedings of eminent domain in the Superior Court of California, County of San Diego, as are necessary to acquire in fee, for the purpose and uses aforesaid, a portion of that certain real property commonly known as 2415 East 20th Street, which is situated in the County of San Diego, and within the City of National City, State of California, more particularly described hereto as EXHIBIT "A". EISER, III -CITY ATTORNEY APPROVED AS TO LEGAL DESCRIPTION: EXHIBIT "A" LEGAL DESCRIPTION That portion of Lot 8, Anita Terrace Subdivision in the City of National City, according to the map thereof Map No. 3744, on file in the Office of the Recorder of the County of San Diego, State of California, described as follows: Commencing at the southeasterly corner of said Lot 8, thence along the southerly line of said lot, North 72°05'21" East, 18.70 feet to a point of cusp with curve concave northeasterly, having a radius of 20.00 feet; thence leaving said southerly line, northwesterly along said curve, through a central angle of 69°11'31", an arc length of 24.15 feet to a point on the westerly line of said lot, said line being nontangent to last mentioned curve; thence along said line, South 17°54'39" East, 12.90 feet to the true point of beginning. The above described parcel contains 66 square feet, more or less. Attached hereto and made a part of this legal description, is a sketch labeled Exhibit "B."
