HomeMy WebLinkAboutCC RESO 15,911RESOLUTION NO. 15,911 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY GRANTING ULTRONICS, INC. AN EXTENSION OF TIME WITHIN WHICH TO FILE A WRITTEN ACCEPTANCE OF ITS FRANCHISE AND A FAITHFUL PERFORMANCE BOND WHEREAS, on March 7, 1989, by Ordinance No. 1970, the City Council of the CITY OF NATIONAL CITY granted a non-exclusive franchise to ULTRONICS, INC. to construct, maintain and operate a cable television system within the City; and WHEREAS, Section 8 of Ordinance No. 1970 requires ULTRONICS, INC. to file a written acceptance of said franchise not later than 12:01 p.m. of the fifteenth day following the adoption of the Ordinance, to wit, March 22, 1989; and WHEREAS, Section 6.10.130 of the National City Municipal Code, which is incorporated into and made a part of Ordinance No. 1970, requires ULTRONICS, INC., concurrently with the filing of the aforementioned acceptance, to file with the City Clerk a faithful performance bond in the amount of $100,000.00, to secure performance of the terms of the franchise; and WHEREAS, ULTRONICS, INC. has requested an extension of up to and including April 10, 1989 within which to furnish the required performance bond; and WHEREAS, Section 8 of Ordinance No. 1970 provides that the City Council, by resolution, may permit the acceptance of the franchise to be filed after the fifteenth day following the adoption of the franchise ordinance, and that the City Council may impose terms and conditions upon said extension. NOW, THEREFORE, BE IT RESOLVED by the City Council of the CITY OF NATIONAL CITY that ULTRONICS, INC. is hereby granted an extension of up to and including April 10, 1989 within which to file with the City Clerk a written acceptance of its cable television franchise and a faithful performance bond in the amount of $100,000.00 to secure its performance under said franchise. 1 PASSED AND ADOPTED this 21st day of March, 1989.
