A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF NATIONAL CITY, CALIFORNIA,
APPROVING A TENTATIVE SUBDIVISION MAP ILA(
SIX DOTS ON APPROXIMATELY .77 ACRES ON THE EAST Sim; OF
K AVENUE BETWEEN 21ST AND 22ND STREETS
APPLICANT: ED SPRAGUE
CASE Fn.F NO. S-1-89
WHEREAS,, an application was submitted for a tentative subdivision map
consisting of six (6) lots on .77 acres on the east side of K Avenue,
between 21st and 22nd Street, on property generally described as:
Lots 1 through 10, inclusive, in Block 20 of Wilbur Addition to
National City, in the City of National City, County of San Diego,
State of California, according to map thereof No. 251, filed in the
office of the County Recorder of San Diego County September 2, 1887,
together with any portion of the streets adjacent thereto as vacated
and closed to public use, that would by operation of law, revert to
said Lots 1 through 10, in said Block 2 (Assessor's Parcel No. 561-283-
01); and
WHEREAS, the Planning Ccmmiission of the City of National City
considered said application and proposed Negative Declaration No. IS-89-2,
oral testimony and documentary evidence at a public hearing held on March
6, 1989, and by Resolution recommended conditional approval of the
application and,
WHEREAS, the City Council of the City of National City considered said
application and ptup sed Negative Declaration No. IS-89-2 at a public
hearing held on April 11, 1989 at which time the City Council considered
oral and documentary evidence, as well as the Lewrd of the proceedings
before the Planning Commission, and the entire contents of Case File Nos. S-
1-89 and IS-89-2, which are incoiE,urated herein by reference; and
WHEREAS, this action is taken pursuant to all applicable procedures
required by State law and City ordinances; and,
WHEREAS, the action hereby taken is found to be essential for the
preservation of the public health, safety and general welfare.
NOW, THEREFORE, BE TT RESOLVED that the City Council has considered
the proposed Negative Declaration together with any comments received
during the public review process and all evidence and testimony presented
at the hearing and finds that on the basis of the Initial Study and any
comments received that there is no substantial evidence that the project
will have a significant effect on the environment, approves the proposed
Negative Declaration, and authorizes the filing of a Notice of
Determination;
BE TP FURTHER RESOLVED by the City Council of the City of National
City that it hereby approves the tentative map for subdivision of one lot
into 6 parcels, based on the following findings:
1. The proposed siih9ivision, together with the provisions for its design
and improvements is consistent with the General Plan, since all
proposed lots exceed 5,000 square feet in area, consistent with the RT
land use designation.
2. The proposed map is consistent with applicable general and specific
plans, since all lots exceed 5,000 square feet in area and there is
no applicable specific plan.
3. The site is physically suitable for the proposed residential type of
development, since grading will provide suitable residential building
sites and existing streets will provide suitable access.
4. The site is physically suitable for the proposed density of
development, since the site contains a total land area of .77 acmes
and grading will provide suitable residential building sites for
development of six (6) duplexes.
5. The design of the subdivision or the proposed improvements are not
likely to cause substantial environmental damage or substantially and
avoidably injure fish or wildlife or their habitat, since the site
does not provide fish or wildlife habitat.
6. The design of the subdivision or the type of improvements are not
likely to cause serious public health problems, since all necessary
public services will be provided.
7. The design of the subdivision or the type of improvements will not
conflict with easements, acquired by the public at large, for access
through or use of property within the proposed subdivision, since no
such easements are located on the site.
8. The discharge of sewerage waste fiuu the subdivision into the City of
National City sewer system will not result in violation of existing
requirements prescribed by the California Regional Water Quality
Control Board pursuant to Division 7 (commencing with Section 13000)
of the Water Code, as specified by Government Code Section 66474.6.
9. The subdivision has been considered by the Planning Commission with
regard to its effect on the housing needs of the region, and these
needs are balanced by the public service needs of the residents and
available fiscal and environmental resources.
10. The design of the subdivision provides, to the extent feasible, for
future passive and natural heating and cooling urtunities in the
subdivision based on consideration to local climate, contour, property
configuration and other design and improvement requirements without
requiring reduction in allowrable density or lot coverage.
BE IT FURTHER RESOLVED, that based on the findings hereinbefore
stated, said tentative subdivision map for six (6) lots on approximately
.77 acres is hereby approved subject to the following conditions:
1. Final Map shall abide by all requirements of the Subdivision Map Act
and the National City Municipal Code, including certificates,
acknowledgments, and complete boundary information, including
monumentation.
2. Sidewalks shall be constructed along the property frontage on 22nd
Street, K Avenue and 21st Street.
3. Pedestrian ramps shall be installed at the northeast corner of 22nd
Street and K Avenue, and at the southeast corner of 21st Street and K
Avenue. Pedestrian ramps shall also be installed at the alley aprons
to the east of the subdivision pPr National City standard drawing 114-
S-B.
4. Improvement plans for the existing alley shall be submitted to the
City Engineer. Improvement of the alley abutting parcels 1, 3, and 4
shall be deferred to the time of issuance of building permits for
development of each parcel.
5. Access to all lots shall be clearly shown on the final map or on the
improvement plans. The proposed driveway shown on the tentative map
on the north side of 22nd Street is in conflict with the existing
storm drain manhole. The driveway should be relocated away from the
manhole. The existing curb depression on the east side of K Avenue
shall be replaced with full height curb and gutter. The widths of all
the proposed driveways shall be shown.
6. The existing fence along the south side of the subdivision shall be
relocated to the property line.
7. Plans shall be submitted for all improvements. A grading plan shall
also be submitted showing the proposed on -site grading as well as the
drainage pattern. Drainage is not allowed to go over sidewalks or
driveways.
8. The type of all proposed retaining walls shall be given.
9. The type and size of the proposed on -site drainage inlet shall be

content by the City Attorney, and recorded concurrently with the Final
Map.
21. The approval of the tentative (parcel) map expires 2 years after
adoption of the Resolution of approval at 5:00 p.m. unless prior to
that date a request for time extension not exceeding an additional 3
has been filed as provided by Section 66452.6(e) of the

California Government Code.
BP IT FURTHER RESOLVED that copies of this Resolution be. transmitted
forthwith to the applicant and to the City Council.
RF IT FURTHER RESOLVED that this action will become final and
effective on the date of its adoption. The time within which judicial
review of this decision may be sought is governed by the provisions of Code
of Civil Procedures Section 1094.6.
