RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY GRANTING DEFERRAL OF
INSTALLATION OF STREET IMPROVEMENTS
AT 1832 RACHAEL AVENUE
(JUSTINIANO GONZALES)
WHEREAS, pursuant to Chapter 13.22 of the National City
Municipal Code, Justiniano Gonzales ("Owner") is required to
install certain street improvements as a condition of
obtaining a building permit to perform remodeling work on his
residence at 1832 Rachael Avenue, at a cost of approximately
$29,000; and
WHEREAS, said street improvements include installation
of sidewalk and removal and replacement of substandard asphalt
concrete pavement in front of the subject property, at a cost
of approximately $2,483; and
WHEREAS, Justiniano Gonzales has requested a deferral
from the required street improvements, in accordance with
Chapter 13.22 of the Municipal Code, and the City Council at
their meeting of May 16, 1989, has considered his request,
the documentation supporting his request, and the staff report
and recommendation of the Engineering Department.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of National City that the requested deferral is granted
as to replacement of asphalt pavement in the street only, on
the condition that Owner execute a covenant running with the
land containing the following provisions:
1. The owner will not protest the installation of any
of the required improvements under 1911 or 1913
Improvement Act Program whether initiated by the
property owners or the City.
2. The owner will install said improvements in
conjunction with an overall improvement program of
the area whether initiated by the property owners
or the City.
3. The owner will install the required improvements
within 30 (Thirty) days of a written demand to do
so by the City Engineer.
PASSED and ADOPTED this 16th day of May, 1989.

This COVENANT is made by Justiniano Gonzales hereinafter
referred to as Ware. WEEREitS C;, . is the owner of that certain real
property located in the City of National City, County of San Diego, State
of California, descriW as follows:
The Southerly 43 feet of the Northerly 243 feet of Lots 310 and 311
in Licoln Acres of Annex No. 2, according to Map No. 1748 filed in
the office of the County Recorder of San Diego County, Feb. 7,1923
WHEREAS, said owner desires to be excused from the legal requirements
to install the following improvements:
406 sq. ft. of street paving

install said improvements by the City Council of the City of National City,
said owner covenants for himself an;

heirs, successors, assigns executors and
administrators as follows:
