HomeMy WebLinkAboutCC RESO 15,952RESOLUTION NO. 15,952 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY GRANTING DEFERRAL OF INSTALLATION OF STREET IMPROVEMENTS AT 1832 RACHAEL AVENUE (JUSTINIANO GONZALES) WHEREAS, pursuant to Chapter 13.22 of the National City Municipal Code, Justiniano Gonzales ("Owner") is required to install certain street improvements as a condition of obtaining a building permit to perform remodeling work on his residence at 1832 Rachael Avenue, at a cost of approximately $29,000; and WHEREAS, said street improvements include installation of sidewalk and removal and replacement of substandard asphalt concrete pavement in front of the subject property, at a cost of approximately $2,483; and WHEREAS, Justiniano Gonzales has requested a deferral from the required street improvements, in accordance with Chapter 13.22 of the Municipal Code, and the City Council at their meeting of May 16, 1989, has considered his request, the documentation supporting his request, and the staff report and recommendation of the Engineering Department. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the requested deferral is granted as to replacement of asphalt pavement in the street only, on the condition that Owner execute a covenant running with the land containing the following provisions: 1. The owner will not protest the installation of any of the required improvements under 1911 or 1913 Improvement Act Program whether initiated by the property owners or the City. 2. The owner will install said improvements in conjunction with an overall improvement program of the area whether initiated by the property owners or the City. 3. The owner will install the required improvements within 30 (Thirty) days of a written demand to do so by the City Engineer. PASSED and ADOPTED this 16th day of May, 1989.
