HomeMy WebLinkAboutCC RESO 16,020RESOLUTION NO. 16,020 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY CONSENTING TO INCLUSION IN THE SAN DIEGO COUNTY VECTOR CONTROL SERVICES ESTABLISHED PURSUANT TO GOVERNMENT CODE SECTION 25842.5 The City Council of the City of National City does hereby resolve as follows: WHEREAS, in accordance with Government Code Section 25842.5, the Board of Supervisors of San Diego County may provide the same services and exercise the powers of a mosquito abatement district or a vector control district formed pursuant to Chapter 5 (commencing with Section 2200) of Division 3 of the Health and Safety Code; and WHEREAS, the Board of Supervisors of San Diego County has determined that the public necessity and welfare requires that the Board expand vector control services and exercise the powers of a vector control district; and WHEREAS, effective July 1, 1989, the Board of Supervisors will provide the same services and exercise the powers of a vector control district in the unincorporated areas of the County; and WHEREAS, before exercising such authority within the incorporated territory of any city, the consent of the city council shall first be obtained; and WHEREAS, the City Council of the City of National City finds that the health, safety, and welfare of its residents will be protected and promoted by the inclusion of the City in the San Diego County Vector Control Services; and WHEREAS, the Board of Supervisors will include within the boundaries of the area to be served under the powers of a vector control district any city whose city council requests inclusion by resolution; and WHEREAS, the City of National City may adopt a resolution on consent of the City Council for the inclusion of its territory in the San Diego County Vector Control Services: 1 NOW THEREFORE, the City Council of the City of National City resolves that this Council approves and consents to the inclusion of the incorporated territory of the City within the boundaries of the San Diego County Vector Control Services, and the services rendered and the concomitant powers exercised as set forth in California Health and Safety Code Section 2200 et seq., including any proper service charge. BE IT FURTHER RESOLVED that the City may discontinue participation in the vector control program by adoption of a resolution and by providing the County written notice of such discontinuance ninety days prior to the beginning of the fiscal year. EISER, III, City Attorney ,ram c.1� GEORGATERS, Mayor 2 APPENDIX I FINDINGS OF THE CITY/COUNTY MANAGERS ASSOCIATION AD HOC COMMITTEE ON THE COUNTY PROPOSAL TO ASSUME THE POWERS OF A VECTOR CONTROL DISTRICT During the May 11, 1989, Ad Hoc Committee meeting the following findings were made concerning. the County Proposal to Assume the Powers of a Vector Control District: 1. There exist serious vector control problems throughout the County, particularly with mosquitoes, and domestic rats. Consequently, residents and visitors of the County are at risk of contracting vector -borne disease such as encephalitis (outbreak in 1984), malaria (outbreaks in 1986 and 1988, largest in the United States since 1953), and plague (documented in the County in 1987), among others. 2. The existing vector control program has not been increased significantly over the past four decades despite tremendous land development and population growth in all areas of the County, and as such it is inadequate and must be expanded. 3. It is understood that the Board of Supervisors believes that it must move forward in an assertive manner to establish a mechanism to fund Comprehensive Vector Control Services. 4. It is understood that the Board of Supervisors may establish a funding mechanism through service charges for the unincorporated areas of the County. Subsequently, cities may receive vector control services by having their City Council pass a resolution to participate in the preventive program. 5. Cities that take part in the preventive program will expect to participate in the annual policy review concerning service levels and parcel fee levels. Any city wishing to discontinue participation in the vector control program may do so by resolution and will provide the County notice of its intentions ninety days prior to the beginning of the fiscal year. 6. It is understood that countywide taxes go into the County General Fund and support the existing program. It is appropriate to continue to use these funds for a countywide program. The Board of Supervisors should consider continuing the use of this funding source and supplement this source with a parcel fee to expand the vector control program. The Ad Hoc Committee raised the general issue of the County's degree of obligation to fund public health and environmental health activities within incorporated cities from the County's General Fund.
