DATE: '181 i Anne Peoples ity Clerk RESOLUTION NO. 16,107 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL ELECTION TO BE HELD ON TUESDAY, FEBRUARY 6, 1990, FOR THE SUBMISSION TO THE VOTERS OF A QUESTION RELATING TO A PROPOSED 7 ORDINANCE ALLOWING CARD ROOMS IN NATIONAL CITY WHEREAS, the City Council of the City of National City desires to submit to the voters at a special municipal election a proposed ordinance relating to allowing card clubs in National City; and WHEREAS, the City Council is thereupon authorized and directed by statute to submit the proposed ordinance to the qualified voters; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to the requirements of the laws of the State of California relating to General Law Cities, there is hereby called and ordered to be held in the City of National City, California, on Tuesday, February 6, 1990, a Special Municipal Election for the purpose of submitting to the voters the following proposed ordinance: Shall an ordinance -be adopted repealing -Ordinance No. 809, and allowing card clubs in Yes National City -in which any games permitted by law, such as draw poker, low -ball poker- and panguingue (pan) are played? No SECTION 2. That the above proposed ordinance to be submitted to the voters is attached hereto as Exhibit "A" and incorporated herein by reference. SECTION 3. That the ballots to be used at the election shall be in the form and content as required by law. SECTION 4. That the City Clerk is authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the election. SECTION 5. That the polls for the election shall be open at seven o'clock a.m. of the day of the election and shall remain open continuously from that time until eight o'clock p.m. of the same day when the polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of California. SECTION 6. That in all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding municipal elections. SECTION 7. That notice of the time and place of holding said election is given and the City Clerk is authorized, instructed and directed to give such further or additional notice of the election in time, form and manner as required by law. AN ORDINANCE OF THE PEOPLE OF THE CITY OF NATIONAL CITY REPEALING ORDINANCE NO. 809, AND ALLOWING CARD CLUBS IN NATIONAL CITY IN WHICH ANY GAMES PERMITTED BY LAW, SUCH AS DRAW POKER, LOW -BALL POKER AND PANGUINGUE (PAN) ARE PLAYED THE PEOPLE OF THE CITY OF NATIONAL CITY DO ORDAIN AS FOLLOWS: SECTION 1. Ordinance No. 809, "AN ORDINANCE FOR POLICE REGULATION, RELATING TO CARD ROOMS AND PLACES WHERE CARD TABLES ARE KEPT FOR HIRE OR PUBLIC USE IN THE CITY OF NATIONAL CITY, CALIFORNIA: REPEALING SECTION 37 OF ORDINANCE 708; REPEALING SECTIONS 2, 3, 4, AND 5 OF ORDINANCE 760, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH," is hereby repealed in its entirety. SECTION 2. The repeal of Ordinance No. 809 shall not repeal any repealing clause of said Ordinance, or revive any ordinance which has been repealed by Ordinance No. 809. SECTION 3. There shall be allowed in National City card clubs in which any games permitted by law, such as draw - poker, low -ball poker and panguingue (pan) are played. SECTION 4. The City Council of the City of National City may enact, amend, and enforce additional ordinances, resolutions and other regulations relating to card clubs. SECTION 5. This Ordinance may be amended or repealed by the City Council of the City of National City. SECTION 6. This Ordinance shall be considered as adopted upon the date that the vote is declared by the City Council of the City of National City, and shall go into effect 10 days after that date.
