HomeMy WebLinkAbout1988 CC RESO 15,493RESOLUTION NO. 15,493 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING COVENANT RUNNING WITH THE LAND LOCA'1'.r.7) WITHIN THE 1600 BLOCK OF PLAZA BOULEVARD, SOUTHSIDE, EAST OF PALM AVENUE, FROM LUCKY 8, A CALIFORNIA GENERAL PARTNERSHIP BE IT RESOLVED by the City Council of the City of National City that the application of Lucky 8, a California General Partnership, for deferral of an additional 6' right of way along the east right of way of Palm Avenue fronting the property, is granted subject to the following conditions: The filing with the Engineering Department of the City of National City a Covenant Running with the Land recorded by the City Clerk of the City of National City, providing: 1. The owner will not protest the installation of any of the required improvements under 1911 Improvement Act program whether initiated by the property owners or the City. 2. The owner will install said improvements in conjunction with an overall improvement program of the area whether initiated by the property owners or the City. Eiser, III -City Attorney COVENANT RUNNING WITH THE LAND This COVENANT is made by LUCKY 8, GENERAL PARTNERSHIP AND GOLDEN SHARES LTD, (PARADISE VALLEY DEVELOPMENT CO.) hereinafter referred to as "OWNER". WHEREAS OWNER is the owner of that certain real property located in the City of National City, County of San Diego, State of California, described as follows: Parcels 2 & 3 of Parcel Map No. 13257, recorded in the office of the County Recorder of San Diego County May 8, 1984. WHEREAS, it is required by the City Council of the City of National City in Resolution NO. 15,184 that the property owner shall record with the County Recorder this Covenant agreeing to hold San Diego County Assessor's parcels 557-410-21 and 557-410-22 as one parcel. NOW, THEREFORE, in consideration for the granting of approval for National City Planned Development permit No. 5-86 by the City Council of the City of National City, said owner covenants for themselves and their heirs, successors, assigns, executors and administrators as follows: 1. The owner will not transfer title to one of the above mentioned parcels without also transfering title to the other parcel to the same entity as one parcel. 2. Condition No. 23 of conditions of approval imposed by City Council Resolution No. 15184 for Conditional Use Permit No. CUP-1986-08 and Planned Development Permit No. 5-86 are binding on all present and future interest holders or estate holders of the property. Owner agrees to dedicate an additional 6' right of way along the east right of way of Palm Avenue fronting the property, to widen the affected portion of Palm Avenue as required by the City F gineer should a project to provide a right turn lane go forward at some future time.
