A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY, CALIFORNIA,
APPROVING A ZONE VARIANCE APPLICATION FOR
CONVERSION OF A RESIDENTIAL STRUCTURE OF
HIS1uaICAL CHARACTER TO NON-RESIDENTIAL USE (OFFICES)
WITH FOUR (4) OFF-STREET PARKING SPACES IN LIEU OF THE
REQUIRED SEVEN (7) SPACES AT 437 G AVENUE.

WHEREAS, the appeal from the Planning Commission's approval of
application for zone variance was considered by the City Council of the
City of National City at a public hearing held on January 12, 1988, at
which time oral and documentary evidence was presented; and
WHEREAS, at said public hearing the City Council considered the entire
contents of Case File Nos. Z-4-87 and IS-87-21, which are maintained by the
City, and incorporated herein by reference; and,
WHEREAS, this action is taken pursuant to applicable pm ures
required by State and City law; and,
WHEREAS, the action recited herein is found to be essential for the
preservation of public health, safety and general welfare; and,
NOW, THEREFORE BE IT RESOLVED by the City Council of 'the City of
National City that testimony and evidence presented to the City Council at
the public hearing held on January 12, 1988 support the following findings:
1. That because of special circumstances applicable to the property,
including size, shape, topography, location or surroundings, the
strict application of Title 18 of the Municipal Code (Zoning) deprives
such property of privileges enjoyed by other property in the vicinity
and under identical zoning classification since the property is listed
in the General Plan as a potentially significant historical site and
the required number of off-street parking spaces could be provided by
demolition of the carriage house but would not be in keeping with the
preservation of the historic characteristics of the site; and
2. That the requested variance is subject to such conditions which will
assure that the adjustment authorized will not constitute a grant of
special privileges inconsistent with the limitation upon other
properties

character, architectural elements and features of the
interior and exterior of the structures be maintained; and
3. That the variance does not authorize a use or activity which is not
otherwise expressly authorized by the zoning regulations governing the
parcel of property, since office usP is a permitted use in the zone.
BE IT FURTHER RESOLVED, that the City Council has considered Negative
Declaration No. IS-87-21, approved by the Planning Commission June 15,
1987, and certifies that the Negative Declaration has been approved
pursuant to- the requirements of the California Environmental Quality Act,
and that the Initial Study and Negative Declaration adequately address the
effects of the project as conditionally approved.
BE IT FURTHER RESOLVED that the application for Zone Variance Z-4-87
is approved subject to the following conditions:
1. Before this Zone Variance shall became effective, the applicant shall
sign and have notarized an Acceptance Form, provided by the Planning
Department acknowledging and accepting all conditions imposed upon the
approval of this permit. The applicant shall also summit evidence to
the satisfaction of the Planning Director that a Notice of Restriction
on Real Property is recorded with the County Recorder. The applicant
shall pay necessary recording fees to the County. The Notice of •
Restriction shall provide information that conditions imposed by
approval of Zone Variance Permit No. Z-4-87 are binding on all present
or future interest holders or estate holders of the property. The
Notice of Restriction shall be approved as to form by the City
Attorney and signed by the Planning Director prior to .tewrdation.
2. Any and all construction at the subject residence/carriage house shall
be required to comply with the State Historical Building Code 1985
edition as adopted by City Ordinance No. 1915.
3. Plans submitted for issuance of a building permit shall be subject to
compliance with applicable codes utilized by the Department of
Building and Safety.
4. All exits shall be in accordance with the Uniform Building Code.
5. Fire extinguishers shall be provided on both floors at locations to be
approved by the Fire Department.
6. Parking lot shall be surfaced with a mi.niimun of two-inch thick asphalt
concrete over four -inch aggregate base.
7. New on -site parking spaces shall be provided with concrete wheel stops
and marked in accordance with Chapter 18.58 National City Municipal
Code.
8. Depth of surfaced area for parking on the south side of the carriage
house shall be increased from the 20-feet shown to a minimum of 23-
feet.
9. All public improvements shall be per San Diego Area Regional Standard
Drawings and Standard Specification for Public Works Construction,
Latest Edition.
10. Development plans shall be submitted and approved by the Planning
Director in conformance with Exhibit "A", Case File No. Z-4-87.
11. New curb and gutter on the west side of the site shall be constructed
along G Avenue for approximately 12-feet in front of the entrance.
12. Existing curb cut (for driveway) on 5th Street shall be iEInuved and
new curb, gutter, sidewalk and landscaping installed.
13. Portland cement concrete paving, approximately 7 feet in width, shall
be constructed for the alley along the east property line which shall
match with the existing pavement and grade to drain.
14. Existing fence located adjacent to property line on 5th Street shall
be extended to the east property line.
15. Plans submitted for issuance of a building permit shall clearly show
the location of the existing sewer lateral of the existing building.
16. Historical character, and existing architectural elements and features
of the exterior and interior of the structure shall be maintained.
17. Any pLoposal to alter the interior or exterior appearance of the two-
story building and carriage house, as well as landscaping, shall be
approved by the City Council upon reoammendation of the National City
Historical Society.
18. All violations of the Uniform Building, Plumbing, and Mechanical codes
shall be corrected, permits shall be obtained and required inspections
shall be requested.
19. Use of the property shall be limited to office use only.
BE IT FURTHER RESOLVED that copies of this Resolution shall be
transmitted forthwith to the applicant.
BE IT FURTHER RESOLVED that this Resolution shall become effective and
final on the day following the City Council meeting where the resolution is
adopted.
