HomeMy WebLinkAbout1988 CC RESO 15,535RESOLUTION NO. 15,535 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL ELECTION TO BE HELD ON TUESDAY, JUNE 7, 1988 FOR THE SUBMISSION TO THE VOTERS A QUESTION RELATING TO A PROPOSED ORDINANCE CHANGING THE APPROPRIATIONS LIMIT FOR FISCAL YEARS 1987-88 THROUGH 1990-91 WHEREAS, the City Council of the City of National City desires to submit to the voters at a special municipal election a proposed ordinance relating to changing the appropriations limit for fiscal years 1987-88 through 1990-91; and WHEREAS, the City Council is thereupon authorized and directed by statute to submit the proposed ordinance to the qualified voters; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to the requirements of the laws of the State of California relating to General Law Cities, there is hereby called and ordered to be held in the City of National City, California, on Tuesday, June 7, 1988, a Special Municipal Election for the purpose of submitting to the voters the following proposed ordinance: ;Shall an ordinance changing the ;City of National City's appropriations ;,limit for fiscal years 1987-88 through 11990-91 to allow the use of all existing ;tax revenue sources by the City be adopted? YES NO SECTION 2. That the proposed ordinance to be submitted to the voters is attached hereto as Exhibit A and incorporated herein by reference. SECTION 3. That the ballots to be used at the election shall be in the form and content as required by law. SECTION 4. That the City Clerk is authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the election. SECTION 5. That the polls for the election shall be open at seven o'clock a.m. of the day of the election and shall remain open continuously from that time until eight o'clock p.m. of the same day when the polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of California. SECTION 6. That in all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding municipal elections. SECTION 7. That notice of the time and place of holding said election is given and the City Clerk is authorized, instructed and directed to give such further or additional notice of the election in time, form, and manner as required by law. Exhibit A AN ORDINANCE OF THE PEOPLE OF THE CITY OF NATIONAL CITY CHANGING THE APPROPRIATIONS LIMIT FOR FISCAL YEARS 1987-88 THROUGH 1990-91 THE PEOPLE OF THE CITY OF NATIONAL CITY DO ORDAIN AS FOLLOWS: SECTION 1. Change of Appropriations Limit. The appropriations limit for fiscal years 1987-88 through 1990-91 set pursuant to Article XIII-B of the California Constitution is changed to the extent set forth in Section 2 of this Ordinance. SECTION 2. Authority to Appropriate Existing Tax Revenue Sources Collected in Fiscal Years 1987-88 Through 1990-91. The City of National City's appropriations limit for fiscal years 1987-88 through 1990-91 provided for in Article XIII-B of the California Constitution shall be increased by an amount equal to the excess, if any, of total revenues, after adjusting for non -proceeds of taxes and appropriations not subject to limitation, over the statutory appropriations limit, to permit the expenditure of anticipated revenues from existing sources to fund needed programs which include, but are not necessarily limited to, police protection, fire protection, library services, parks and facility and infrastructure maintenance and capital improvements. SECTION 3. Saving Clause. This initiative ordinance is intended to comply with California Constitution Article XIII-B. If any section, part, clause, form, word or phrase is for any reason held to be invalid, the remaining portions of this ordinance shall remain in full force and effect and shall be interpreted to serve the intent of this ballot proposition.
