HomeMy WebLinkAboutCC RESO 15,623RESOLUTION NO. 15,623 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AGREEING TO PROPERTY TAX EXCHANGE BETWEEN THE CITY OF NATIONAL CITY AND SAN DIEGO COUNTY LIGHTING MAINTENANCE DISTRICTS NO. 1 AND 3 WHEREAS, San Diego County Lighting Maintenance District No. 1 and 3, hereinafter referred to as LMD1 and LMD3, are proposed to be dissolved; and WHEREAS, a new assessment district known as the San Diego County Street Lighting District, hereinafter referred to as the District, is proposed to be formed as successor agency to LMD1 and LMD3; and WHEREAS, the District shall contain all and only that territory in the unincorporated area of the County; and WHEREAS, the dissolution of LMD1 and LMD3 and formation of the District are not required to be reviewed and approved by the Local Agency Formation Commission; and WHEREAS, the City of National City has service responsibilities that would be altered by the proposed change; and WHEREAS, the Revenue and Taxation Code 99(c) requires the acceptance, by resolution, of the negotiated exchange of property tax revenues by all affected agencies; and WHEREAS, the Board of Supervisors of the County of San Diego has negotiated with the City to determine an equitable exchange of property tax revenues applicable to such jurisdictional exchange; NOW THEREFORE, BF IT RESOLVED THAT the negotiated exchange of property tax revenues shall be as follows: a. Within the incorporated City of National City, all property tax revenues (both based and annual tax increment) shall be transferred to the City. b. Within the unincorporated territory, all property tax revenues (both base and annual tax increment) shall be transferred to the San Diego County Street Lighting District as the successor agency to LMD1 and LMD3. BE IT FURTHER RESOLVED THAT subsequent annexation of properties to National City shall result in detachment ficxu the San Diego County Street Lighting District and a transfer of property taxes to the City of National City pursuant to the Master Property Tax Agreement adopted by the Board of Supervisors on November 20, 1984. BE IT FURTHER RESOLVED THAT the City Clerk shall, on behalf of the City, notify the County Auditor of such negotiated exchange of property tax revenues by forwarding to him a copy of this resolution.
