HomeMy WebLinkAboutCC RESO 15,639RESOLUTION NO. 15,639 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT WITH THE WILLIAM REYNOLDS CONSTRUCTION CO., INC., FOR REMOVAL AND REPLACEMENT OF UNDERGROUND TANKS WHEREAS, the Public Works Director, on May 26, 1988, publicly opened sealed bids for the removal and replacement of underground tanks; and WHEREAS, the low conforming bidder is the WILLIAM REYNOLDS CONSTRUCTION COMPANY, INC. NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council of the City of National City rejects all bids except that herein mentioned, and hereby awards the contract for REMOVAL AND REPLACEMENT OF UNDERGROUND TANKS to: WILLIAM REYNOLDS CONSTRUCTION CO., INC. BE IT FURTHER RESOLVED that the Mayor is hereby authorized to execute on behalf of the City the contract and the contract modification agreement between WILLIAM REYNOLDS CONSTRUCTION CO., INC., and the City to provide for removal and replacement of underground tanks. EISER, III CITY ATTORNEY City of National City Public Works Department 2100 Hoover Ave., National City, CA 92050-6599 (619) 336-4360 June 7, 1988 CONTRACT MODIFICATION AGREEMENT Reference: Contract to Remove and Replace Underground Fuel Tanks Specification No. 1007 WHEREAS, The referenced contract required that a figure of 150 cubic yards be used to multiply the unit price bid for removal of contaminated soil, solely as a device to be used in evaluating bids in order to determine the low bidder; WHEREAS, there is no accurate method to determine the quantity of contaminated soil that will be encountered during construction, or if any contaminated soil will be found; THEREFORE, the parties to the referenced contract mutually agree to delete from the total bid price the bid item for excavation and removal of 150 cubic yards of contaminated soil, as set forth in the special provisions, paragraph 1.4.1, at a unit price of $230.00 per cubic yard. The new total bid price will therefore be $160,650.00. The contractor further agrees that the unit price of $230.00 per cubic yard for excavation and removal of contaminated soil, if any, will not change during the life of the contract, including any extensions thereof. If any contaminated soil is encountered during the course of construction, the contractor will be compensated at the above rate by additive change order. This agreement shall be effective concurrently with the execution of the construction contract, and the con- struction contract shall be executed in the amount of $160,650.00. There will be no change in the contract time for completion. WILLIAM REYNOLDS CONST. CITY OF NATIONAL CITY CO., INC. By: CONTRACT SPECIFICATION NO. 1,007 THIS AGREEMENT, made this, the 15th day of June, 1988, by and between City of National City hereinafter called "OWNER," acting herein through its Mayor, and William Reynolds Construction Company, Inc., a corporation in the State of California hereinafter called "CONTRACTOR." WITNESSETH: That for and in consideration of the payments and agreements hereinafter mentioned, to be made and performed by the OWNER, the CONTRACTOR hereby agrees with the OWNER to commence and complete the construction described as follows: Remove and Replace Underground Fuel Tanks, including the contract modification agreement of June 7, 1988, Hereinafter called the project, for the sum of One Hundred Sixty Thousand Six Hundred Fifty Dollars ($160,650.00) and all extra work in connection therewith, under the terms as stated in the General and Special Provisions of the Contract; and at his own proper cost and expense to furnish all the materials, supplies, machinery, equipment, tools, superintendence, labor, insurance, sales tax, and other accessories and services necessary to complete the said project in accordance with the conditions and prices stated in the Bidder's Proposal, the General Provisions and Special Provisions of the Contract, the Plans, which include all maps, plats, blueprints, and other drawings, and printed or written regulatory matter thereof, the specifications and contract documents therefor, all which are made a part hereof and collectively evidence and constitute the Contract. The CONTRACTOR hereby agrees to commence work under this contract on or before a date to be specified in a written "NOTICE TO PROCEED" of the OWNER and to fully complete the project within Ninety (90) working days thereafter. The CONTRACTOR further agrees to pay, as liquidated damages, the sum of $200.00 for each consecutive calendar day that he is in excess of the time specified for completion. The OWNER agrees to pay the CONTRACTOR in current funds for the performance of the contract, subject to additions and deductions, as provided in the General Provisions of the Contract, and to make payments on account thereof.
