HomeMy WebLinkAboutCC RESO 15,658RESOLUTION NO. 156 58 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY GRANTING EXEMPTION OF INSTALLATION OF STREET IMPROVEMENTS WHEREAS, pursuant to Chapter 13.22 of the National City Municipal Code, James Martinez and Vickie Martinez are required to install certain street improvements as a condition of obtaining a building permit to perform remodeling work on their residence at 618 F Avenue, at a cost of approximately $8,000; and WHEREAS, said street improvements include removal and replacement of existing deteriorated curb in front of the subject property, at a cost of approximately $750.00; and WHEREAS, James Martinez and Vickie Martinez have requested an exemption from the required street improvements, in accordance with Chapter 13.22 of the Municipal Code, and the City Council at their meeting of June 14, 1988, has considered their request, the documentation supporting their request, and the staff report and recommendation of the Engineering Department. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the requested exemption is granted for the following reasons: 1. It would be impractical to install the improvements because of permanent inadequacy of the physical conditions of the property to accomodate those improvements. 2. There is factual evidence that such improvements would not be in the public interest because of incompatability with neighborhood design such as interference with open space, yards, trees, fences, wall and parkways. 3. Installation of street improvements would preclude tearing down old garage and building new one. Continuous use of old garage could cause a dangerous condition to the public.
