A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY, CALIFORNIA,
APPROVING A TENTATIVE SUBDIVISION MAP FOR
A 21-UNIT OONDOMINIUM PROJECT ON THE
WEST SIDE OF V AVENUE BEIMEEN 5TH AND 7TH STREETS.
APPLICANT: VICTOR RODRIGUEZ
CASE FILE NO. S-3-87
WHEREAS, an application was submitted for a tentative
subdivision map for a 21-unit condominium project on approximately 1.5
acres of land on the west side of V Avenue between 5th and 7th
Streets, approximatley 100 feet to 600 feet south of 5th Street, on
property generally described as a portion of the southeast 1/4 of 1/4
Section 130, Rancho de la Nacion; and,
WHEREAS, the Planning Cbmmnission of the City of National City
considered said application, and proposed Negative Declaration (IS-87-
48) oral testimony and documentary evidence at a public hearing held
on November 2, 1987 and by Resolution recommended conditional approval
of the application; and,
WHEREAS, the City Council of the City of National City considered
said application and proposed negative Declaration (No. IS-87-48), at
a public hearing held on December 8, 1987 at which time the City
Council considered oral and documientary evidence, as well as the
record of the proceedings before the Planning Commission, and the
entire contents of Case File Nos. S-3-87 and IS-87-48, which are
incorporated herein by reference; and
WHEREAS, this action is taken pursuant to all applicable
procedures required by State Law and City Ordinances; and,
WHEREAS, the action hereby taken is found to be essential for the
preservation of the public health, safety and general NOW, THEREFORE, BE IT RESOLVED that the City Council has
considered the proposed Negative Declaration together with any
comments received during the public review process and all evidence
and testimony presented at the hearing and finds that on the basis of
the Initial Study and any comments received that there is no
substantial evidence that the project will have a significant effect
on the environment, approves the ptuposed Negative Declaration, and
authorizes the filing of a Notice of Determination.
BE IT FURTHER RE:YIT,VED by the City Council of the City of
National City that it hereby approves the tentative map for a 21-unit
condominium project on approximately 1 .5 acres on the west side of V
Avenue, approximately 100 to 600 feet south of 5th Street, based on
the following findings:
1. The tentative map is consistent with the National City General
Plan., since 21-units are proposed on property containing a net
buildable area of 1.5 acres, consistent with the RM-1 land use
designation.
2. The design or improvement of the proposed subdivision is
consistent with the National City General Plan, since 21-units
are proposed on property containing a net buildable area of 1.5
acres, consistent with the RM-1 land use designation.
3. The site is physically suitable for the proposed residential type
of development, since proposed grading will provide suitable
residential building sites and proposed building layout and
design, perimeter wall and landscaping will provide a suitable
residential environment.
4. The site is physically suitable for the proposed density of
development, since proposed grading and unit design will
accommodate 21-units with adequate unit size and parking and
recreational areas on the site.
5. The design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or
substantially and unavoidably injure fish or wildlife or their
habitat, since the site does not contain significant vegetation
and drns not provide fish or wildlife or their habitat.
6. The design of the subdivision or the type of improvements is not
likely to cause serious public health problems, since all
necessary public services will be provided.
7. The design of the subdivision or the proposed improvements will
not conflict with easements, acquired by the public at large, for
access through or use of, property within the proposed
subdivision.
8. The discharge of sewerage waste fin the subdivision into the
National City sewer system will not result in violation of
existing requirements prescribed by the California Regional Water
Quality Control Board pursuant to Division 7 (Commencing with
Section 13000) of the Water Code, as specified by Government Code
Section 66474.6.
9. The subdivision has been considered by the Planning Commission
with regard to its effect on the housing needs of the region, and
these needs are balanced by the public service needs of the
residents and available fiscal and environmental resources.
10. The design of the subdivision provides, to the extend feasible,
for future passive or natural heating and cooling opportunities
in the subdivision, based upon considerations of local climate,
contour, property configuration and other design and improvement
requirements without additional reduction in allowable density or
lot coverage.
BE IT FURTHER RESOLVED, that based on the findings hereinbefore
stated, said tentative subdivision map for 21 condominium units on
approximately 1.5 acres on the west side of V Avenue, approximately
100 to 600 feet south of 5th Street, is hereby approved subject to the
following conditions:
1. Final Map shall abide by all requirements of the Subdivision Map
Act and the National City Municipal Code, including certificates,
acknowledgments, complete boundary information and monumentation.
2. A grading plan shall be submitted by the developer and approved
by the City Engineer prior to approval of the final map.
3. A soils report showing the stability of the proposed slopes,
allowable bearing soil pressure, retaining wall criteria, etc.
shall be submitted to the City Engineer prior to approval of the
final map (Report Number shall be shown on the grading plan).
4. Public improvements shall be done for the portions of V Avenue
and 7th Street for City Drawing No. 4696 D, filed with the City
Engineering Department. Structural section of streets shall be
per. City Drawings 113-5-13.
5. Developer must perform the work or enter into an agreement to
perform the monumentation and all improvements listed above
before final map approval, based upon cost estimates approved by
the City Engineer.
6. Fire lanes shall be provided as designated by the City Fire
Department.
7. The required fire flow is 2,000 g.p.m. for 3-hours at a minimum
20 p.s.i.
8. Smoke detectors shall be provided in each dwelling unit as well
as the recreation roam. A heat detector shall be provided for
the laundry roam.
9. Fire extinguishers shall be provided throughout the complex.
10. Sprinkler protection shall be provided for the garages.
11. The developer shall submit a detailed landscape/irrigation plan
Showing installation of erosion retardant materials on all slopes
for approval by the Planning Director prior to issuance of a
grading permit for the site.
12. All erosion retardant landscaping shall be installed at the time
the site is graded.
13. A water main extension will be required in 7th Street and V
Avenue. The subdivider shall submit a letter to the Sweetwater
Authority stating fire flow requirements and shall enter into an
agreement for water facility improvements with the Authority
prior to approval of the Final Map.
14. The approval of the tentative (parcel) map expires 2 years after
adoption of the Resolution of approval at 5:00 p.m. unless prior
to the date a request for time extension not exceeding an
additional 3 years has been filed as provided by Section 66452.6
(e) of the California Government Code.
15. Planned Development Permit approval shall be obtained and
conditions of the Planned Development approval shall be
satisfied.
16. The designated areas of open space (tot lot and recreation
building) shall be held in common ownership for the permanent use
and enjoyment of all the owners of the development and shall be
set forth as separate lots on the final subdivision map.
17. The applicant shall provide a declaration of covenants,
conditions and restrictions, running with the land, clearly
setting forth the privileges and responsibilities, including,
maintenance, payment of taxes, etc., involved in the common
ownership, prior to approval of the final subdivision map. Said
covenants, conditions, and restrictions shall be subject to
approval as to form and content by the City Attorney.
18. A corporation, association, property owners' group, or similar
entity shall be formed with the right to assess all the
properties which are jointly owned with interests in the can
areas and facilities in the entire development or in the tract
which is a part of the entire development to meet the expenses of
such entity, and with authority to control, and the duty to
maintain, all of said mutually available features of the
development or tract portion thereof.
A. Such entity shall operate under recorded covenants,
conditions and restrictions which shall include compulsory
membership of all owners of lots and flexibility of
assessments to meet changing costs of maintenance, repairs
and services.
B. The developer shall submit evidence of uiapliance with the
requirement of this section to the Planning Director.
C. This condition shall not apply to land dedicated to the City
and included in an open space maintenance district, or
dedicated to the City for other public purposes.
19. The Final Map shall be recorded prior to the issuance of a
building permit.
BE IT FURTHER RESOLVED that copies of this Resolution be
transmitted forthwith to the applicant.
BE IT FILER RESOLVED that this action will became final and
effective on the date of its adoption. The time within which judicial
review of this decision may be sought is governed by the provisions of
Ccr1P of Civil Procedures Section 1094.6.
