A RESOLUTION OF 111i CITY COUNCIL OF '1'tit; CITY OF
NATIONAL CITY, CALIFORNIA, DENYING WITHOUT PREJUDICE A TENTATIVE
PARCEL MAP FOR TWO PARCELS ON 0.45 ACRES LOCATED ON THE SOUTH
SIDE OF 16TH STREET, 132 ITIa WEST OF EARLE DRIVE
APPLICANT: DON AYLES (ERB ENGINEERING) FOR
ARMANDO A. BARTOLOME AND FU-HUA AND ANGELA TAO-SHUN HO
CASE FILE NO. LS-9-86
WHEREAS, the appeal to the City Council from the Planning Commission's
denial of tentative parcel map (LS-9-86) was considered by the City Council of
the City of National City at a public hearing held on July 28, 1987, at which
time oral and documentary evidence was presented; and,
WHEREAS, at said public hearing the City Council considered the entire
contents of Case File Nos. LS-9-86 and IS-86-62 which are maintained by the
City, and incorporated herein by reference; and,
WHEREAS, this action is taken pursuant to all applicable procedures required
by State and City law; and,
WHEREAS, the action recited herein is found to be essential for the
preservation of public health, safety and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National
City, California, based on testimony and evidence introduced in the staff report
and public hearing for said tentative parcel map, makes the following findings:
1. The tentative parcel map does not comply with the lot size, access and
improvement standards specified by Section 17.36.040 of the National
City Municipal Code, as explained below.
a. Curbs, sidewalks and paving would not be installed along all
public street frontages, if the proposed 1911 Act improvement
district for 17th Street is not approved.
b. Separate sewer facilities and connections will not be provided to
each proposed parcel if 17th Street improvements are not
completed, except by an easement across one parcel with an
undesirable requirement for pumping.
2. The site is not physically suitable for the proposed density of
development, based on available information regarding future
development, since vehicular access and separate electrical, water and
sanitary sewer facilities and connections cannot be provided to Parcel
1 without an undesirable easement over Parcel 2 to 16th Street, and a
pump is required to provide the necessary sewer connection to 16th
Street.
BE IT FURTHER RESOLVED that based on the findings hereinbefore stated, said
tentative parcel map for two parcels on 0.45 acres located on the south side of
16th Street is hereby denied without prejudice.
BE IT FURTHER RESOLVED that copies of this Resolution be transmitted
forthwith to the applicant.
BE IT FURTHER RESOLVED that this Resolution shall become effective and final
on the day following the City Council meeting where the resolution is adopted.
The time within which judicial review of this decision may be sought is governed
by provisions of Code of Civil Procedure Section 1094.6.
