A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY, CALIFORNIA, DENYING
WITHOUT PREJUDICE A ZONE VARIANCE APPLICATION FOR
CONVERSION OF A RESIDENTIAL STRUCTURE OF HISTORICAL
CHARACTER TO NON-RESIDENTIAL USE (OFFICES) WITH 4
OFF-STREET PARKING SPACES IN LIEU OF THE REQUIRED 7
SPACES AT 437 "G" AVENUE
APPLICANT: JOHN 0. OCHSNER
CASE FILE NO. Z-4-87/CP-1-87
WHEREAS, the appeal by the City Council of the Planning Commission's
approval of application for Zone Variance (Z-4-87/CP-1-87) was considered by the
City Council of the City of National City at a public hearing held on August 11,
1987, at which time oral and documentary evidence was presented; and,
WHEREAS, at said public hearing the City Council considered the entire
contents of Case File Nos. Z-4-87/CP-1-87 and IS-87-21 which are maintained by
the City, and incorporated herein by reference; and,
WHEREAS, this action is taken pursuant to all applicable procedures required
by State and City law; and,
WHEREAS, the action recited herein is found to be essential for the
preservation of public health, safety and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National
City, California, that the testimony and evidence presented to the City Council
at the public hearing held on August 11, 1987, failed to support findings that
because of special circumstances, applicable to the property, the strict
application of Title 18 of the Municipal Code (Zoning) deprives this property of
privileges enjoyed by other property in the vicinity and under identical zoning
classification; and that the variance shall be subject to conditions as will
assure that the adjustment authorized by the variance shall not constitute a
grant of special privileges inconsistent with the limitations upon other
properties in the vicinity and zone in which such property is situated.
BE IT FURTHER RESOLVED that the testimony and evidence presented to the City
Council at the public hearing held on August 11, 1987, support the following
findings:
A. That the elimination of three off-street parking spaces could result in
inadequate parking for the proposed use, and would have a negative impact on
surrounding properties.
B. That the legally -required number of parking spaces could easily be
provided by removing the carriage house located on the property, which is not
essential for the proposed use.
BE IT FURTHER RESOLVED that the City Council hereby denies, without
prejudice, the application for Zone Variance Z-4-87 and plans for conversion of
a residential structure of historical character to non-residential use (CP-1-
87) ; and,
BE IT EAR RESOLVED that copies of this Resolution shall be transmitted
forthwith to the applicant; and,
BE IT FURTHER RESOLVED that this Resolution shall become effective and final
on the day following the City Council meeting where the resolution is adopted.
The time within which judicial review of this decision may be sought is governed
by the provisions of Code of Civil Procedures Section 1094.6.
