RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT BETWEEN
THE CITY OF NATIONAL CITY AND THE CITY OF CHULA VISTA
PROVIDING FOR THE USE OF CHULA VISTA'S POUND
FACILITIES AND SERVICES AND AUTHORIZING
APPROPRIATION AND TRANSFER OF FUNDS
BE IT RESOLVED that the Mayor is authorized and directed to execute
and the City Clerk to attest that certain "Agreement" between the City of Chula
Vista and the City of National City providing for the use of Chula Vista's pound
facilities and services; this agreement being in full force on the first day of July
1986 and terminating on the 30th day of June 1988.
BE IT FURTHER RESOLVED by the City Council of the City of National
City that it hereby authorizes, appropriates and directs the following transfer of
funds be made in order to meet necessary budget requirements:

AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND THE
CITY OF NATIONAL CITY PROVIDING F❑R THE USE OF
CHULA VISTA'S POUND FACILITIES AND SERVICES
THIS AGREEMENT, made and entered into this 21st day of
July , 1987, by and between THE CITY OF CHULA VISTA, a
municipal corporation, hereinafter called "Chula Vista", and THE CITY
OF NATIONAL CITY, hereinafter called "National City";
W I T N E S S E T H:
WHEREAS, the City of National City desires to use the pound
facilities of the City of Chula Vista as a shelter for the impounding
and disposing of dogs and small animals, and
WHEREAS, The City of Chula Vista has pound facilities
adequate to serve the needs of the City of National City in addition
to the present use by the City of Chula Vista, and
WHEREAS, the City of.National City desires to extend the
existing agreement with the City of Chula Vista for the use of the
pound facilities of the City of Chula Vista as a shelter for the
impounding and disposing of dogs and small animals, and
WHEREAS, the City of Chula Vista is willing to extend said
agreement amended in the manner set forth herein.
NOW. THEREFORE, IT I5 AGREED by and between Chula Vista and
National City as follows:
1. Chula Vista agrees to permit the City of National City
to utilize pound facilities owned and operated by the City of Chula
Vista as shelters for the impounding and disposal of dogs, cats and
other animals that are impounded in all portions of the incorporated
territory of the City of National City.
2. Chula Vista agrees to perform all normal pound services,
including among other things, the following:
a. Confinement, feeding, destruction and disposal of dogs
and small animals.
b. Use of euthanization by injection on a regularly
scheduled basis.
c. Reasonable use of the Animal Shelter offices and
facility.
d. Reservation of not more than fifteen (15) kennels and
three (3) quarantine cages, for the use of the City of
National City.

3. Chula Vista agrees to provide pound facilities and

9:00 a.m. to 5:00 p.m., six days a week, excluding holidays,

5. Animals brought into the Shelter will be euthanized if
they are not redeemed by their owners or adopted by new owners. In
any case, euthanasia will not take place any sooner than 72 hours
after the animal has been received. The only exception to the 72-hour
rule is the case of seriously ill or injured animals.
6. Retroactive to July 1, 1987 and extending through June
30, 1988, National City agrees to pay the City of Chula Vista the sum
of TWO THOUSAND FOUR HUNDRED THIRTY DOLLARS AND FORTY-EIGHT CENTS
($2,430.48) per month for the aforementioned services and facilities.
The Finance Office of the City of Chula Vista shall, as of the first
day of each month, credit National City with the amount of monies
received during the previous month from National City residents as
fees for redemption or adoption of National City animals. To the
balance of funds remaining to be paid, a one percent (1%) service and
billing charge shall be applied. The Finance Officer shall submit the
billing to National City on or before the loth day of the month
following the billing period, and that amount shall be due and payable
upon receipt by National City, but in no event later than the last day
of the billing month.
7. Chula Vista shall not be responsible to any resident of
National City, or to the City of National City, because of the
destruction ofany animal delivered to and accepted by the pound
facilities pursuant to this agreement, and the City of National City
agrees to hold harmless the City of Chula Vista from any claims
arising from damage or injury to animals belonging to residents of the
City of National City and delivered to the Chula Vista Animal Shelter
facilities.
IT IS FURTHER AGREED that this amended agreement shall take
effect and be in full force on the first day of July, 1987 and shall
terminate on the 30th day of June, 1988, provided, however, that
either party may terminate this agreement at any time by giving to the
other party written notice of intention to terminate ninety (90) days
following said notice.
IN WITNESS WHEREOF, this agreement is executed by the City
of Chula Vista acting by and through its Mayor and by the City of
National City acting by and through its Mayor, the date and year first
hereinabove written.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND THE CITY OF NATIONAL CITY FOR USE OF THE CHULA
VISTA ANIMAL SHELTER
AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Chula Vista that that certain agreement between THE
CITY OF CHULA VISTA, a municipal corporation, and THE CITY OF
NATIONAL CITY, for use of the Chula Vista Animal Shelter
dated the 21st day of July , 1987 , a copy of which is
attached hereto and incorporated herein, the same as though fully
set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista be, and he is hereby authorized and directed to
execute said agreement for and on behalf of the City of Chula
Vista.
