HomeMy WebLinkAboutCC RESO 15,289RESOLUTION NO. 15,289 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, DENYING CONDITIONAL USE PERMIT AND PLANNED DEVELOPMENT PERMIT APPLICATIONS FOR CONSTRUCTION OF A 52-UNIT MOTEL AT THE NORTHEAST CORNER OF 7TH STREET AND ROOSEVELT AVENUE APPLICANT: CHIVAY HSU ARCHITECTS CASE FILE NOS. CUP-1986-14/PD-08-86 WHEREAS, the appeal to the City Council from the Planning Commission's denial of applications for Conditional Use Permit (CUP-1986-14) and Planned Development Permit (PD-08-86) was considered by the City Council of the City of National City at a public hearing held on December 9, 1986 and continued to the meetings of January 13, 1987, February 10 and 24, and April 28, 1987, at which time oral and documentary evidence was presented; and, WHEREAS, at said public hearing the City Council considered the entire contents of Case File Nos. CUP-1986-14, PD-08-86 and IS-86-39 which are maintained by the City, and incorporated herein by reference; and, WHEREAS, this action is taken pursuant to all applicable procedures required by State and City law; and, WHEREAS, the action recited herein is found to be essential for the preservation of public health, safety and general welfare; and, WHEREAS, the testimony and evidence presented to the City Council at the public hearing indicated potential police problems associated with the proposed use, that there is an aggregation of similar uses in the area, that there is an undesirable site plan and design (shaded pool area) for the use, that the proposed building is excessively bulky, that the site is too small for the density of development proposed, and that the market study submitted in conjunction with this development indicates a low occupancy rate in new motels, and accordingly, this testimony and evidence failed to support a finding that the proposed use will not have an adverse effect upon adjacent or abutting properties or that the proposed use is essential and desirable to the public convenience and welfare. NOW, THEREFORE, BE IT RESOLVED that applications for Conditional Use Permit No. CUP-1986-14 and Planned Development Permit No. PD-08-86 are denied, based on the following findings: 1. There is a potential for police problems associated with the proposed use. The motel -developed area between 5th and 7th Streets on Roosevelt Avenue has, over the past years, been a constant problem for the police department. Budget type motels of the type proposed have consistently attracted clientele who tend to become easy prey for the criminal element. 2. There is an over -abundance of this type of motel in the area. Within a distance of 800 feet of the project site there are 186 budget type motel units. 3. An undesirable site plan has been proposed. Specifically, the proposed swimming pool is proposed to be constructed in a location shaded by buildings. 4. The proposed building is excessivly bulky. A four story building is too large for the size of the lot. 5. The lot size is too small for the density of development proposed. 6. The "South San Diego Budget Nbtel Study," an independent market feasibility study proposed by Castaneda & Associates in February, 1987, included the following findings: a) Budget motels, especially newer motels, are experiencing low occupancy levels. b) Several motel projects are proposed which have the potential to increase the supply of motel romps in the city, requiring the city to be selective in the motel projects which it approves. c) The rates which the applicant has stated he will be charging would be the highest in the City; it is questionable whether the level of amenities offered would justify these rates. d) While most of the demand for National City motel rooms can be attributed to Navy/government and business/commercial users, there is further demand from persons relocating to the area and from persons lacking sufficient funds to rent an apartment. This fact, coupled with the potential for low occupancy rates, would tend to cause the proposed motel to become a low rent apartment. 7. For the above reasons, the proposed use will have an adverse affect on adjacent and abutting properties. 8. For the above reasons, the proposed use is not deemed to be essential and desirable to the public convenience and welfare. BE IT FURTHER RESOLVED that copies of this Resolution shall be transmitted forthwith to the applicant; and, BE IT FURTHER RESOLVED that this Resolution shall become effective and final an the day following the City Council meeting where the resolution is adopted. The time within which judicial review of this decision may be sought is governed by the provisions of Code of Civil Procedures Section 1094.6. PASSED and ADOPTED this 5th day of May, 1987.
