A RESOLUTION OF THE CITY .COUNCIL OF
THE CITY OF NATIONAL CITY, CALIFORNIA,
APPROVING A PLANNED DEVELOPMENT PERMIT APPLICATION
FOR AN 11,604 SQUARE FOOT SHOPPING CENTER AT
1545 HARBISON AVENUE
APPLICANT: MEHRAD BEGHBEH
CASE FILE NO. PD-2-87
WHEREAS, the appeal of the City Council from the Planning Commission's
approval of application for Planned Development Permit Application (PD-2-87) was
considered by the City Council of the City of National City at a public hearing held
on May 12, 1987, at which time oral and documentary evidence was presented; and,
WHEREAS, at said public hearing the City Council considered the entire contents
of Case File Nos. PD-2-87, Z-1-87 and IS-87-2 which are maintained by the City, and
incorporated herein by reference; and,
WHEREAS, this action is taken pursuant to all applicable procedures required by
State and City law; and,
WHEREAS, the action recited herein is found to be essential for the preservation
of public health, safety and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City, California, that the testimony and evidence presented to the City
Council at the public hearing held on May 12, 1987, support the following findings:
A. That the site for the proposed use is adequate in size and shape. There
exists 170 feet of frontage on Harbison Avenue and 220 feet of frontage on
16th Street with a total land area of 35,250 square feet. Adequate parking
and landscaping areas will be provided for the proposed use.
B. That the site has sufficient access to streets and highways that are
adequate in width and pavement type to carry the quantity and quality of
traffic generated by the proposed use. The project site fronts on 16th
Street and on Harbison Avenue, which are both 60 foot wide collector
streets.
C. That the proposed use will not have an adverse effect upon adjacent or
abutting properties. The introduction of this project into the neighborhood
will increase the viability of existing businesses within the neighborhood and
create an impetus to their improvement. The single family residences to
the north and east of the site will be provided with landscaping and
screening which do not now exist around the vacant lot and gasoline station.
D. That the proposed use is deemed essential and desirable to the public
convenience or welfare. The proposed neighborhood shopping center will
provide services and convenience shopping to vehicular and walk-up traffic
which is not now provided. The project is designed to enhance this corner
which has high traffic volume but which is adjacent to residential
neighborhoods. The existing use of this corner does not contribute to the
value or quality of life of the neighborhood. Also the proposed use is
consistent with the land use designation of the Combined General
Plan/Zoning Map and will replace a non -conforming use.
BE IT FURTHER RESOLVED that the City Council has considered Negative
Declaration No. IS-87-2, approved by the Planning Commission March 16, 1987 and
certifies that the Negative Declaration has been approved pursuant to the
requirements of the California Environmental Quality Act, and that the Initial Study
and Negative Declaration adequately address the effects of the project as
conditionally approved.
BE IT FURTHER RESOLVED that the application for Planned Development
Permit is approved subject to the following conditions:
1. The required fire flow shall be 2500 G.P.M. for 5-hours at a minimum 20
P.S.I. Sweetwater Authority shall verify in writing to the National City
Fire Department that the existing hydrants will meet this flow. If the
hydrants cannot meet this flow an additional hydrant or sprinkler protection
shall be provided.
2. Fire lanes shall be provided as designated by the National City Fire
Department.
3. Parking lot shall be surfaced with a minimum two-inch thick asphalt
concrete over four -inch thick aggregate base.
4. All improvements shall be per San Diego Area Regional Standard Drawings
and Standard Specifications for Public Works Construction, latest edition.
5. A drainage and grading plan including key elevations, drainage flow, catch
basins, etc., shall be submitted to and approved by the City Engineer prior
to issuance of a building permit. No drainage shall be allowed over
driveways. Drainage shall be collected on -site with catch basins and
conveyed to street gutter through sidewalk under drains.
6. A new pedestrian ramp shall be constructed at the northeast curb return of
Harbison Avenue and 16th Street.
7. Either a ten -foot wide strip of right-of-way fronting Harbison Avenue shall
be dedicated to the City of National City, or a copy of Title Report shall
be submitted to the City Engineer if a ten -foot wide strip has already been
dedicated, prior to issuance of a building permit.
8. All proposed and existing lateral dimensions of curb to centerline of street
and curb to property line shall be shown on the grading plan along l6th
Street and Harbison Avenue.
9. The sale of alcoholic beverages on these premises shall be prohibited.
10. Ten -foot wide setback located adjacent to the southerly 120 feet of the
east property line shall be landscaped rather than surfaced with gravel as
shown on plans submitted.
11. A decorative masonry wall, at least five (5) feet in height, shall be
constructed adjacent to the north and east property lines.
12. Development, except as otherwise provided herein, shall be in accordance
with Exhibit "A", Case File No. PD-2-87, dated February 5, 1987.
13. Before this Planned Development Permit shall become effective, the
applicant shall file a written statement with the Planning Department,
acknowledging and accepting all conditions imposed upon the approval of
this permit. The applicant shall also submit evidence to the
satisfaction of the Planning Director that a Notice of Restriction on
Real Property is recorded with the County Recorder. The applicant
shall pay necessary recording fees to the County. The Notice of
Restriction shall provide information that conditions imposed by
approval of Planned Development Permit No. PD-2-87 are binding on all
present or future interest holders or estate holders of the property.
14. Within a period not to exceed one year after the effective date of
resolution approving this project, the applicant shall submit evidence
to the satisfaction of the Planning Director that the 30-foot wide
right-of-way located adjacent to the east property line of the project
site has in fact been vacated.
15. A traffic study, paid for by the property owner and administered by the
City, is required prior to the issuance of a building permit. If it is
determined that a traffic signal is required at the intersection of
16th Street and Harbison Avenue, the property owner shall pay that part
of the traffic signal installation costs which is proportional to the
amount of traffic generated by this project, as determined by the City
Engineer. Prior to issuance of a building permit, the property owner
shall pay to the City his part of the traffic signal installation
costs, or post a bond or other improvement security acceptable to the
City Engineer to cover such costs.
BE IT FURTHER RESOLVED that copies of this Resolution shall be transmitted
forthwith to the applicant.
BE IT FURTHER RESOLVED that this Resolution shall become effective and final
on the day following the City Council meeting where the resolution is adopted.
The time within which judicial review of this decision may be sought is governed
by the provisions of Code of Civil Procedures Section 1094.6.
