A RESOLUTION OF '111E CITY COUNCIL OF
THE CITY OF NATIONAL CITY, CALIFORNIA, APPROVING
A ZONE VARIANCE APPLICATION TO ALLOW REDUCTION
IN FRONT YARD SETBACK FROM 20-rEE TO 15-$r r,
AND TO ALLOW PORTIONS OF WALLS LOCATED WITHIN
THE REQUIRED FRONT YARD SETBACK TO EXCEED 4-r1'
IN HEIGHT ON PROPERTY LOCATED WITHIN THE
1400 TO 1500 BLOCK OF GROVE STREET, WEST SIDE.

CASE FILE NO. Z-06-86
WHEREAS, the appeal to the City Council from the Planning Commission's
denial of application for zone variance (Z-06-86) was considered by the City
Council of the City of National City at a public hearing held on January 13,
1987 at which time oral and documentary evidence was presented; and
WHEREAS, at said public hearing the City Council considered the entire
contents of Case File Nos. Z-06-86 and IS-86-51, which are maintained by the
City, and incorporated herein by reference; and
WHEREAS, this action is taken pursuant to all applicable procedures
required by State and City law; and
WHEREAS, the action recited herein is found to be essential for the
preservation of public health, safety and general welfare; and
WHEREAS,'said evidence and testimony support a finding that the
variance is necessary to develop the property and supports the following
findings which are required by the Municipal Code for granting a zone variance:
1. That the strict application of the zoning regulations deprives
this property of privileges enjoyed by other property in the
vicinity and under identical zoning classification because the
site is long and narrow (66 feet by 455 feet) and slopes steeply,
rising to the west approximately 10 to 20 feet above Grove Street
level within a 66 foot distance. Individual lots have a maximum
depth of 65.96 feet.
2. That the variance requested is subject to such conditions that the
adjustments would not constitute a grant of special privileges
inconsistent with the limitation upon other properties in the
vicinity and zone in which such property is located because
reduction in front yard setback will apply equally to all
properties fronting the west side of Grove Street between 14th and
16th Streets, except the corner lot at 16th Street, which observes
a 10-foot exterior side yard setback. Properties fronting the
east side of Grove Street are all developed with a 20-foot front
yard setback. However, each parcel on this side of the street is
relatively flat and has a minimum lot depth of 125-feet and a lot
area of 7,500 square feet.
3. That the variance does not authorize a use not otherwise
expressly authorized by the zoning regulations governing the
parcel of property. Detached single-family use is permitted
by the RS-3 zone which applies to the subject property.
BE IT FURTHER RESOLVED that the City Council has considered the
proposed Negative Declaration No. IS-86-51 together with any comments
received during the public reivew process, finds on the basis of the
Initial Study and any comments received that there is no substanitial
evidence that the project will have a significant effect on the
environment, approves the Negative Declaration, and authorizes the filing
of a Notice of Determination.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City, that application for zone variance (Z-06-86) is approved
subject to the following conditions:
1. All walls (retaining and freestanding) shall be constructed
of decorative masonry.
2. All slopes shall be planted with erosion control type
landscaping.
3. Except as otherwise provided herein, development shall be in
accordance with Planning Department Exhibit "A", Case File
No. Z-06-86, dated October 10, 1986.
4. A detailed landscape/irrigation plan shall be prepared by a
California Licensed Landscape Architect and approved by the
Planning Director prior to issuance of building permit.
Plants and/or vines approved by the Planning Director as to
type and species shall be provided between the public
sidewalk on Grove Street and masonry walls constructed on
property line.
5. All improvements shall be per San Diego Area Regional Standard
Drawings, and standard specifications for public works
construction latest edition.
6. Structural calculations shall be submitted for the non-standard
retaining walls. Soil pressure to be per soils report.
7. A minimum distance of 20-feet shall be provided between the
garage and property line on Grove Street.
BE IT FURTHER RESOLVED that copies of this Resolution shall be
transmitted forthwith to the applicant.
BE IT FURTHER RESOLVED that this Resolution shall become effective
and final on the day following the City Council meeting where the resolution
is adopted. The time within which judicial review of this decision may be
sought is governed by the provisions of Code of Civil Procedure Section
1094.6.
