A RESOLUTION OF THE CITY COUNCIL OF l'Hh CITY OF NATIONAL CITY,
CALIFORNIA, APPROVING A PLANNED DEVELOPMENT PERMIT APPLICATION FOR
THE DEVELOPMENT OF THREE (3) DETACHED, SINGLE-FAMILY DWELLINGS
AT 304 NORTON AVENUE
APPLICANT: DOMINO() GUTIERREZ
CASE FILE NO. PD-06-86
WHEREAS, the appeal to the City Council from the Planning
Commission's denial of application for Planned Development Permit Application
(PD-06-86) was considered by the City Council of the City of National City at
a public hearing held on January 13, 1987, at which time oral and documentary
evidence was presented; and
WHEREAS, at said public hearing the Planning Commission considered
the entire contents of Case File Nos. PD-06-86 and IS-86-36 which are
maintained by the City, and incorporated herein by reference; and
WHEREAS, this action is taken pursuant to all applicable procedures
required by State and City law; and
WEEPI'AS, the action recited herein is found to be essential for the
preservation of public health, safety and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City, California, that the testimony and evidence presented to the
City Council at the public hearing held on January 13, 1987, support the
following findings:
A. That the site for the proposed use is adequate in size and shape.
The site is surrounded by multi -family units on 3-sides. The
project site has 75-feet of frontage on Norton Avenue, a depth of
240 feet, and contains a land area of 18,000 square feet. The
site is not subdividable.
B. That the site has sufficient access to streets and highways that
are adequate in width and pavement type to carry the quantity and
quality of traffic generated by the proposed use.
The project site fronts on Norton Avenue, a neighborhood street
that provides direct access to 4th Street, a collector street,
and Palm Avenue, an arterial street with access to I-805.
C. That the proposed use will not have have an adverse effect upon
adjacent or abutting properties.
Development of three detached single-family dwelings on this site
will be compatible with the multi -family and two-family use on
adjacent properties.
D. That the proposed use is deemed essential and desirable to the
public convenience or welfare.
The project will provide detached, single-family units in an area
where there is a shortage of this type of housing and where the
applicable RS-3 designation of the General Plan/Zoning Map calls
for such type of land use.
BE IT FURTHER RESOLVED that the City Council has considered the
proposed Negative Declaration No. IS-86-36, together with any comments
received during the public review process, and finds on the basis of the
Initial Study and any comments received that there is no substantial evidence
that the project will have a significant effect on the environment, approves
the Negative Declaration, and authorizes the filing of a Notice of
Determination.
BE IT FURTHER RESOLVED that the application for Planned Development
Permit is approved subject to the following conditions:
1. On -site improvements shall be in accordance with San Diego Area
Regional Standard Drawings and Standard Specifications for Public
Works construction, 1982 Edition.
2. A drainage and grading plan shall be submitted to and approved by
the City Engineer prior to issuance of a building permit. Key
elevations shall be shown. A concrete gutter shall convey site
drainage to Norton Avenue.
3. An engineering variance is required for driveway located less
than eleven (11) feet from south property line.
4. Profile of driveway shall be submitted to and approved by the
Engineering Department and Planning Department prior to issuance
of a building permit.
5. Existing curb cut shall be replaced with concrete curb and
sidewalk.
6. Top of wall and top of footing elevations for proposed walls
and standard type of wall shall be shown on grading plan.
7. Driveway shall be constructed of 4-inch thick Portland cement
concrete outside of public right-of-way.
8. Public sidewalk adjacent to project site on Norton Avenue
shall be constructed contiguous to the curb.
9. All units shall be provided with smoke detectors in
accordance with applicable provisions of the Uniform Building
Code.
10. Required fire flow shall be 1000 GPM at a minimum 20 PSI for
two hours. Sweetwater Authority shall certify in writing
that existing hydrants meet this flow prior to issuance of a
building permit.
11. No Parking, fire lane signs shall be installed on the south
side of the driveway. Size, number and location shall be
approved by the City Fire Chief prior to installation. This
access shall remain unobstructed.
12. Project site shall be screened from adjacent properties.
Wood fences shall not be used for required screening.
However, wood fences (good neighbor type) in conjunction with
dense landscape may be used for required screening. Interior
yard wood fences used to screen one area of open space from
another shall be landscaped on both sides.
13. A detailed landscape/irrigation shall be submitted to and
approved by the Director of Planning prior to issuance of a
building permit. All sprinkler heads located in or within 3-
feet of the parkway shall be pop-up.
14. Each dwelling unit shall be provided with a trash receptacle
enclosure approved by the Planning Department.
15. All utility service wires shall be underground.
16. A concrete sidewalk at least 3-feet in width shall be provided
adjacent to north edge of driveway in areas of proposed
landscape to connect with public sidewalk on Norton Avenue.
17. All garages shall have a minimum inside width of 24 feet.
18. Except as otherwise provided herein, development shall be in
accordance with National City Planning Department Exhibit "B",
Case File PD-06-86, dated October 7, 1986.
19. Before this Planned Development permit shall become effective,
the applicant shall file a written statement with the Planning
Department, acknowledging and accepting all conditions imposed
upon the approval of this permit. The applicant shall also
submit evidence to the satisfaction of the Planning Director
that a Notice of Restriction on Real Property is recorded with
the County Clerk. The Notice of Restriction shall provide
information that conditions imposed by approval of Planned
Development Permit No. PD-06-86 are binding on all present or
future interest holders or estate holders of the property.
20. Fencing shall be provided between residential units.
BE IT FURTHER RESOLVED THAT copies of this Resolution be transmitted
forthwith to the applicant and,
BE IT FINALLY RESOLVED THAT this Resolution shall become effective
and final on the day following the City Council meeting where the Resolution
is adopted. The time within which judicial review of this decision may be
sought is governed by the provisions of Code of Civil Procedures Section
1094.6
