A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA, APPROVING A TENTATIVE PARCEL MAP FOR THE DIVISION OF
1.4 ACRES INTO 6 LOTS LOCATED AT THE
SOUTHWEST CORNER OF 26TH STREET AND J AVENUE.

WHEREAS, application was made for approval of a tentative parcel map to
divide 1.4 acres of property located at the southwest corner of 26th Street and
J Avenue into 6 lots; and,
WHEREAS, the City Council of the City of National City, California,
considered said application and proposed Negative Declaration at a public
hearing held on September 23, 1986, at which time the City Council considered
oral and documentary evidence and the entire contents of Case File No. 5-2-86
and IS 86-28, which are incorporated herein by reference; and,
WHEREAS, this action is taken pursuant to all applicable procedures
required by State law and City Ordinances; and,
WHEREAS, the action hereby taken is found to be essential for the
preservation of public health, safety and general welfare; and,
WHEREAS, the Planning Commission of the City of National City at their
meeting on July 21, 1986, recommended that the City Council adopt proposed
Negative Declaration (IS-86-28) and approve Tentative Map for the division of
1.4 acres into 6 lots on property located at the southwest corner of 26th Street
and "J" Avenue, subject to twenty (20) conditions.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City that it hereby approves a tentative map for the division of 1.4
acres (approximately 61,200 square feet) into 6 lots on property located at the
southwest corner of 26th Street and J Avenue, based on the following findings:
1. The tentative map is consistent with the National City General Plan.
2. The design or improvement of the proposed subdivision is consistent
with the National City General Plan.
3. The site is physically suitable for the residential type of
development.
4. The site is physically suitable for the proposed density of
development.
5. The design of the subdivision or the proposed improvements are not
likely to cause substantial environmental damage or substantially and
unavoidably injure fish or wildlife or their habitat.
6. The design of the subdivision or the type of improvements is not likely
to cause serious public health problems.
7. The design of the subdivision or the proposed improvements will not
conflict with easements, acquired by the public at large, for access
through or use of, property within the proposed subdivision.
8. The discharge of sewerage waste from the subdivision into the National
City sewer system will not result in violation of existing requirements
prescribed by the California Regional Water Quality Control Board
pursuant to Division 7 (Commencing with Section 13000) of the Water
Code, as specified by Government Code Section 66474.6.
9. The Subdivision has been considered by the Planning Commission with
regard to its effect on the housing needs of the region, and these
needs are balanced by the public service needs of the residents and
available fiscal and environmental resources.
10. The design of the subdivision provides, to the greatest extent
feasible, for future passive or natural heating and cooling
opportunities in the subdivision, based upon considerations of local
climate, contour, property configuration and other design and
improvement requirements without additional reduction in allowable
density or lot coverage.
BE IT FURTHER RESOLVED that the City Council has considered the proposed
Negative Declaration No. IS-86-28, together with any comments received during
the public review process and finds on the basis of the Initial Study and any
comments received that there is no substantial evidence that the project will
have a significant effect on the environment, and hereby adopts the proposed
Negative Declaration.
BE IT FURTHER RESOLVED, that based on the findings hereinbefore stated,
said tentative subdivision map for division of 1.4 acres into 6 lots is hereby
approved subject to the following conditions:
1. The approval of the tentative map expires 2 years after adoption of
this resolution at 5:00 p.m. unless prior to that date a request for
a time extension not exceeding an additional three years has been
filed as provided by Section 66452.6 (e) of the California Government
Code.
2. The Final Map shall conform with all requirements of the Subdivision
Map Act and the National City Municipal Code, including certificates,
acknowledgement, and complete boundary information, including
monumentation.
3. 26th Street and Lazzaro Court shall be improved with a minimum of
three-inch thick asphalt concrete over eight -inch thick crushed
aggregate base, with curb, gutter and sidewalk as shown on the
submitted tentative map (Exhibit B, Case File No. S-2-86, dated 7-8-
86).
4. A cul-de-sac at Lazzaro Court shall be constructed having a minimum
radius of thirty-five feet. A profile of Lazzaro Court cul-de-sac is
required. A cross gutter shall be provided at Lazzaro Court and 26th
Street, and drainage shall be addressed to the satisfaction of the
City Engineer.
5. An on -site drainage/grading plan shall be submitted and approved by
the City Engineer.
6. A soils report shall be submitted and approved by the City Engineer.
7. All streets shall be dedicated as public streets.
8. A street light is required at the south end of the cul-de-sac.
9. All improvements shall be per San Diego Area Regional Standard Plans
and Standard Specifications for Public Works Construction, 1982
Edition.
10. All utilities to the subdivision shall be underground.
11. Handicapped ramps are required, two at Lazzaro Court and one at 26th
Street and J Avenue (specific locations to be designated by the City
Engineer).
12. Conditions 2 (monumentation only), 3, 4, 8, 10, 11 may be bonded for in
lieu of actual construction prior to approval of final map, in a manner
approved by the City Attorney.
13. Building location on Parcels 1 and 4 shall observe a front yard setback
from 26th Street, and an exterior side yard setback from Lazzaro Court.
14. A detailed landscape/irrigation plan for all lots including adjacent
parkways, shall be submitted concurrently with required on -site
drainage and grading plans, or prior to said plans, before approval of
the final map, and shall be approved by the Director of Planning.
15. The Final Map shall comply with conditions required by the National
City Municipal Code, Section 17.28, Improvements, and Section
17.36.040, Approval - Conditions.
16. The final map shall be recorded prior to issuance of any building
permit.
17. Fire flow and hydrant' requirements shall be provided to the
satisfaction of the Fire Department.
18. The subdivider shall provide evidence that fire flow requirements are
available from the Sweetwater Authority to serve proposed structures,
and shall enter into an agreement with the Sweetwater Authority for
water facility improvements necessary to serve the subdivision, prior
to approval of the final map.
19. A site development plan shall be approved by the Planning Commission
indicating locations of buildings and other improvements, landscaping,
driveway access, elevations, building materials and color.
Architectural details of proposed buildings shall be compatible with
existing buildings. Existing buildings shall be improved with
painting, and other exterior building restoration, and new landscaping.
20. The total number of lots shown on the final map shall not exceed 6.
