HomeMy WebLinkAboutCC RESO 15,097RESOLUTION NO. 15,097 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA,DENYING AN APPLICATION FOR CONDITIONAL USE PERMIT TO ALLOW THE SALE OF BEER AND WINE AS AN INCIDENTAL USE TO A CONVENIENCE MARKET AT 2602 EAST 18TH STREET APPLICANT: MIGUEL C. SERRANO CASE FILE NO. CUP-1986-11 WHEREAS, the appeal of the applicant from the Planning Commission's denial of Conditional Use Permit CUP-1986-11 was considered by the City Council of the City of National City at a public hearing held on September 23, 1986, at which time oral and documentary evidence was presented; and WHEREAS, at said public hearing the City Council considered the entire contents of Case File No. CUP-1986-11, which is maintained by the City, and incorporated herein by referance; and, WHEREAS, this action is taken pursuant to all applicable procedures required by State and City law; and, WHEREAS, the action recited herein is found to be essential for the preservation of public health, safety and general welfare. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City, California, that the testimony and evidence presented to the City Council at the public hearing held on September 23, 1986, failed to support a finding that the proposed use is deemed essential and desirable to the public convenience and welfare, as required by Section 18.16.020 of the Municipal Code for granting any conditional use permt. BE IT FURTHER RESOLVED THAT the application for Conditional Use Permit is denied for the following reason: The proposed use is not deemed essential and desirable to the public convenience and welfare at this location because there is an existing convenience market located directly across Lanoitan Avenue from the subject site that sells beer and wine as an incidental use, and a liquor store across 18th Street to the north that sells beer, wine and distilled spirits as a principal use. An overconcentration of liquor outlets would result from the proposed project. PASSED and ADOPTED this 7th day of October, 198.
