A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA, APPROVING AN APPLICATION FOR ZONE VARIANCE TO ALLOW
ACCESS FOR DEVELOPMENT ON A LOT WITH NO STREET FRONTAGE,
THROUGH A PRIVATE EASEMENT EXTENDING APPROXIMATELY
40 r riw TO THE LOT FROM THE SOUTHERLY TERMINUS OF
CASA PLACE.

CASE FILE NO. Z-03-86
WHEREAS, the appeal of the City Council from the Planning Commission's
approval of application for zone variance was considered by the City Council of
the City of National City at a public hearing held on November 11, 1986, at
which time oral and documentary evidence was presented; and
WHEREAS, at said public hearing the City Council considered the entire
contents of Case File Nos. Z-03-86 and IS-86-32, which are maintained by the
City, and incorporated herein by reference; and,
WHEREAS, this action is taken pursuant to all applicable procedures required
by State and City law; and,
WHEREAS, the action recited herein is found to be essential for the
preservation of public health, safety and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National
City that testimony and evidence presented to the City Council at the public
hearing held on November 11, 1986, support the following findings:
1. That because of special circumstances applicable to the property,
including size, shape, topography, location or surroundings, the strict
application of Title 18 of the Municipal Code (Zoning) deprives such
property of privileges enjoyed by other property in the vicinity and
under identical zoning classification, since the property has no street
access or frontage and cannot be developed without a variance for
access via easement.
2. That the variance requested is subject to such conditions that the
adjustment would not constitute a grant of special privileges
inconsistent with the limitation upon other properties in the vicinity
and zone in which such property is located, since the property has no
street frontage.
3. That the variance does not authorize a use not otherwise expressly
authorized by the zoning regulations governing the parcel of property.
Detached single-family use is permitted by the RT zone which applies to
the subject property.
BE IT FURTHER RESOLVED that the City Council has considered the proposed
Negative Declaration No. IS-86-32 together with any comments received during the
public review process, finds on the basis of the Initial Study and any comments
received that there is no substantial evidence that the project will have a
significant effect on the environment, approves the Negative Declaration, and
authorizes the filing of a Notice of Determination.
BE IT FURTHER RESOLVED that the application for Zone Variance Z-03-86 is
approved subject to the following conditions:
1. Before this zone variance shall become effective, the applicant shall
file a written statement with the Planning Department, acknowledging
and accepting all conditions imposed upon the approval of this permit.
The applicant shall also submit evidence to the satisfaction of the
Planning Director that a Notice of Restriction on Real Property is
recorded with the County Clerk. The Notice of Restriction shall
provide information that conditions imposed by approval of Zone
Variance No. Z-03-86 are binding on all present or future interest
holders or estate holders of the property.
2. An Ingress -Egress easement shall be granted from impacted owners.
3. Driveway surface shall be 5 1/2" P.C.C. due to the steepness of the
land, subject to final approval by the City Engineer. A profile of the
driveway shall be submitted.
4. A drainage/grading plan shall be submitted, including profiles and
types of retaining walls, and approved by the City Engineer.
5. Required fire flow (for two -detached single-family dwellings) is 1000
GPM for 2 hours at a minimum 20 PSI. Required fire flow shall be
provided to the satisfaction of the Fire Department.
6. The hammerhead turn -around shall be 20 feet wide at the south end.
(Plan currently shows approximately 12 feet wide area.)
7. Fire lanes shall be designated by Fire Department with curbs painted
red and "NO PARKING - FIRE LANE" signs posted.
8. Development plans shall be submitted and approved by the Planning
Director for construction of two, single-family, detached dwelling
units in a manner that would provide for the possibility of a future
lot split with one dwelling per lot.
9. Landscape plans and improvements shall be approved by the Director of
Planning to address coverage of the proposed retaining wall with vines
and additional slope landscaping.
BE IT FURTHER RESOLVED that copies of this Resolution shall be transmitted
forthwith to the applicant and the City Council.
BE IT FURTHER RESOLVED that this Resolution shall become effective and final
on the day following the City Council meeting where the resolution is adopted.
