HomeMy WebLinkAboutCC RESO 15,133RESOLUTION ND. 15,133 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, APPROVING AN APPLICATION FOR ZONE VARIANCE TO ALLOW THE CREATION OF 2-LOTS WITH LESS THAN 50 FEET OF FRONTAGE ON A DEDICATED STEEE , AND 2-LOTS WITH NO STREET FRONTAGE, WITH ACCESS TO ALL LOTS THROUGH A PRIVATE EASEMENT AND 3-LOTS LESS THAN 50 k';1' IN WIDTH, AT THE EAST END OF FIRST STREET, BETWEEN L AVENUE AND LAUREL AVENUE. APPLICANT: JOSEPH M. MLYFrA, JR. CASE FILE NO. Z-8-85 WHEREAS, the appeal of the City Council from the Planning Commission's denial of application for Zone Variance No. Z-8-85 was considered by the City Council of the City of National City at a public hearing held on November 11, 1986, at which time oral and documentary evidence was presented; and WHEREAS, at said public hearing the City Council considered the entire contents of Case File No. Z-8-85 and IS-85-70 which are maintained by the City and incorporated herein by reference; and WHEREAS, this action is taken pursuant to all applicable procedures required by State and City law; and WHEREAS, the action recited herein is found to be essential for the preservation of public health, safety and general welfare. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that testimony and evidence presented to the City Council at the public hearing held on November 11, 1986 support the following findings: 1. That because of special circumstances applicable to the property, including size, shape, topography, location or surroundings, the strict application of Title 18 of the Municipal Code (Zoning) deprives such property of privileges enjoyed by other property in the vicinity and under identical zoning classifications, since the project site has a total land area of about 32,000 square feet, with 65 feet of frontage of L Avenue and 14 feet on Laurel Avenue and the unusal shape of this property limits its development. 2. That the variance requested is subject to such conditions that the adjustment would not constitute a grant of special privileges inconsistent with the limitation upon other properties in the vicinity and zone in which such property is located, since granting of the variance will enable the subdivision of property with similar average lot size to that of the area to the west of the project site. 3. That the variance does not authorize a use not otherwise expressly authorized by the zoning regulations governing the parcel of property. Detached single-family use is permitted by the RS-3 zone which applies to the subject property. BE IT FURTHER RESOLVED that the City Council has considered the proposed Negative Declaration No. IS-85-70 together with any comments received during the public review process, finds on the basis of the Initial Study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment, approves the Negative Declaration, and authorizes the filing of a Notice of Determination. BE IT FURTHER RESOLVED that the application for Zone Variance Z-8-85 is approved subject to the following conditions. 1. Before this zone variance shall become effective, the applicant shall file a written statement with the Planning Department, acknowledging and accepting all conditions imposed upon the approval of this permit. The applicant shall also submit evidence to the satisfaction of the Planning Director that a Notice of Restriction on Real Property is recorded with the County Clerk. The Notice of Restriction shall provide information that conditions imposed by approval of Zone Variance No. Z-8-85 are binding on all present or future interest holders or estate holders of the property. 2. A final parcel map shall be recorded subject to conditions imposed upon the approval of Lot Split Application, Case File No. LS-7-85. 3. Required parking for single-family residences on each lot shall be provided within garages. BE IT FURTHER RESOLVED that a copy of this resolution be transmitted forthwith to the applicant; and BE IT FURTHER RESOLVED that this resolution shall become effective and final on the day following the City Council meeting where the resolution is adopted.
