HomeMy WebLinkAboutCC RESO 15,138RESOLUTION NO. 15,138 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, APPROVING A TENTATIVE PARCEL MAP FOR THE DIVISION OF .73 ACRES INTO 4 LOTS LOCATED AT THE EAST END OF FIRST S'1'xr�T, BETWEEN "L" AVENUE AND LAUREL AVENUE. (A.P.N. 554-011-21 & 23) APPLICANT: JOSEPH M. ALOTTA, JR. CASE FILE NO. LS-7-85 WHEREAS, application was made for approval of a tentative parcel map to divide .73 acres of property at the east end of First Street between "L" Avenue and Laurel Avenue into 4 lots; and WHEREAS, the Planning Commission of the City of National City, California, considered said application at a public hearing held on September 15, 1986, and by Resolution No. 47-86 dated October 6, 1986 denied the application on the grounds that the companion Zone Variance No. Z-8-85 had been denied; and WHEREAS, the City Council of the City of National City considered said application and proposed Negative Declaration at a public hearing held on November 11, 1986, at which time the City Council considered oral and documentary evidence, as well as the record of the proceedings before the Planning Commission, and the entire contents of Case File No. LS-7-85 and IS- 85-70, which are incorporated herein by reference; and WHEREAS, this action is taken pursuant to all applicable procedures required by State law and City Ordinances; and, WHEREAS, the action hereby taken is found to be essential for the preservation of public health, safety and general welfare. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that it hereby approves the proposed tentative map, maintained in Case File No. LS-7-85, for the division of .73 acres (approximately 31,656 square feet) into 4 lots at the east end of First Street, between "L" Avenue and Laurel Avenue, based on the following findings: 1. The tentative map is consistent with the National City General Plan since the single family residential extendable (RS-3) land use category applies to the project site and permits a minimum lot size of 5,000 square feet which proposed lots conform to. 2. The design or improvement of the proposed subdivision is consistent with the National City General Plan. 3. The site is physically suitable for the proposed residential type of development. 4. The site is physically suitable for the proposed density of development. 5. The design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and unavoidably injure fish or wildlife or their habitat. 6. The design of the subdivision or the type of improvements is not likely to cause serious public health problems. 7. The design of the subdivision or the proposed improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. 8. The discharge of sewerage waste from the subdivision into the City of National City sewer system will not result in violation of existing requirements prescribed by the California Regional Water Quality Control Board pursuant to Division 7 (commencing with Section 13000) of the Water Code, as specified by Government Code Section 66474.6. 9. The subdivision has been considered by the City Council with regard to its effect on the housing needs of the region, and these needs are balanced by the public service needs of the residents and available fiscal and environmental resources. 10. The design of the subdivision provides, to the extent feasible, for future passive and natural heating and cooling opportunities in the subdivision, (based upon consideration of local climate, contour, property configuration and other design and improvement requirements without requiring reduction in allowable density or lot coverage). 11. The proposed subdivision complies with improvement requirements, and a zone variance (Z-8-85) has been approved authorizing variation in lot size and access requirements, specified by Section 17.36.040 of the National City Municipal Code. BE IT FURTHER RESOLVED that the City Council has considered the proposed Negative Declaration No. IS-85-70 together with any comments received during the public review process, finds on the basis of the Initial Study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment, approves the Negative Declaration, and authorizes the filing of a Notice of Determination. BE IT FURTHER RESOLVED that based on the findings hereinbefore stated, said tentative parcel map for division of 0.73 acres into 4 parcels is hereby approved subject to the following conditions: 1. Final Map shall abide by all requirements of the Subdivision Map Act and the National City Municipal Code, including certificates, acknowledgements, and complete boundary information, including monumentation. Monumentation shall be done or agreement to do the work shall be approved by the City Engineer prior to approval of the final map. 2. A grading plan showing pad elevations for all four structures at each parcel is required. Sewer laterals shall have a minimum 2 percent grade to sewer main. Grading plan shall be approved by the City Engineer and the grading either done or agreement to do the work shall be approved by the City Engineer prior to approval of the final map. (Key elevations, drainage, retaining walls, etc., shall be shown.) 3. A paved driveway having a minimum width of 24 feet with a minimum 24 foot radius paved cul-de-sac is required. A "T" or "L" type turnaround is also acceptable. 4. Easement reservations for all lots shall be called out in the final map . to assure public access and utility services for these lots. 5. A 10-foot wide right-of-way dedication for street purposes is required along the property's frontage to "L" Avenue. 6. "L" Avenue shall be widened to 20-feet from centerline. Curb, gutter, and sidewalk is required along the property's frontage to "L" Avenue. NOTE: An agreement to do the work can be executed for items 2, 3 and 6. 7. Each parcel shall have a minimum size of 5,000 square feet. 8. The developer shall submit a detailed landscape/irrigation plan showing installation of erosion retardant materials on all slopes for approval by the Planning Director prior to issuance of a grading permit for the site. 9. All erosion retardant landscaping shall be installed at the time the site is graded. 10. A note shall be placed on the final map requiring that development conform to conditions of Zone Variance Z-8-85. 11. Building plans shall be approved by the Director of Planning prior to approval of grading plans. 12. A 10 ft.-wide sewer easement shall be provided through Parcel 4 to Laurel Avenue. 13. The subdivider shall submit a letter to the Sweetwater Authority stating fire flow requirements and shall enter into an agreement for water facility improvements with the Authority prior to approval of the Final Map. Necessary main extension in L Avenue shall be provided. 14. The approval of the lot split application (tentative parcel map) expires 2 years after adoption of the Resolution of approval at 5:00 P.M. unless prior to the date a request for time extension not exceeding an additional 3 years has been filed as provided by Section 66452.6 (e) of the California Government Code. BE IT FURTHER RESOLVED that copies of this Resolution be transmitted forthwith to the applicant; and BE IT FURTHER RESOLVED that this Resolution shall become effective and final on the day following the City Council meeting where the resolution is adopted.
