RESOLUTION OF '1'Hh CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING
AND ORDERING THE PROPOSED "LINCOLN ACRES REORGANIZATION"
(INCLUDING ANNEXATION 7O NATIONAL CITY, DETACHMENT FROM THE
SPRING VALLEY SANITATION DISTRICT AND DISSOLUTION OF THE LOWER
SWEE4WA'!ER FIRE PROTECTION DISTRICT) SUBJECT 7.O CONFIRMATION BY THE
REGISTERED VOTERS RESIDING WITHIN 'IHh AFFEC'lEU TERRITORY
WHEREAS, a petition was submitted to the San Diego Local Agency
Formation Commission (LAFCO) for a reorganization of territory including
annexation to the City of National City, and detachment from the Spring Valley
Sanitation District, which petition was certified sufficient by the Executive
Officer on December 12, 1985; and
WHEREAS, pursuant to the District Reorganization Act of 1965
(Government Code Section 56000 et seq.) a public hearing on the proposed
Lincoln Acres Reorganization was held on March 3, 1986, LAFCO having provided
notice of the date, time, and place of said hearing in accordance with
Government Code Section 56264 and 56265; and
WHEREAS, on March 3, 1986, LAFCO adopted its Resolution No. RO 85-16,
approving the proposed "Lincoln Acres Reorganization," including annexation of
territory to the City of National City, detachment of territory from the
Spring Valley Sanitation District, and dissolution of the Lower Sweetwater
Fire Protection District, designating the City of National City as the
conducting authority, and authorizing the City Council of the City of National
City to initiate proceedings in compliance with Resolution No. RO 85-16, and
with notice, hearing and an election; and
WHEREAS, in accordance with Government Code Sections 56363 and 56433,
the City Council of the City of National City held a public hearing on May 13,
1986, to consider the proposed reorganization after duly advertising and
noticing said hearing in accordance in accordance with Government Code
Sections 56361, 56362, 56431 and 56432; and
WHEREAS, at said hearing on May 13, 1986, the City Council heard and
received any oral or written protests against the reorganization, any request
with respect to modification of its terms and conditions, and any objections
or evidence which were made, presented or filed.
NOW, TBEREFORE, BE IT RESOLVED AND ORDERED AS FOLLOWS:
1. The City Council has considered the factors specified in
Government Code Section 56435.
2. The territory proposed to be reorganized is inhabited.
3. The terms and conditions of the proposed reorganization, as
adopted by the Local Agency Formation Commission, are shown
in Exhibit B.
4. LAFCO has reviewed and certified the Negative Declaration of
environmental impact for the Lincoln Acres Reorganization
dated February 6, 1986.
5. The reorganization, consisting of the annexation of territory
to the City of National City, detachment of territory from
the Spring Valley Sanitation District, and dissolution of the
Lower Sweetwater Fire Protection territory, having boundaries
as described in Exhibit A, is hereby ordered subject to
confirmation of the voters.
BE IT FORT ER RESOLVED AND ORDERED AS FOLLOWS:
1. Pursuant to Government Code Section 56439, an election is
hereby called to be held within the boundaries of the
proposed Lincoln Acres Reorganization, as described in
Exhibit A, upon the question of such reorganization.
2. The date of the election shall be November 4, 1986.
3. The question to be submitted to the voters shall be:
"Shall the order adopted on May 27, 1986, by the City Council
of the City of National City ordering a reorganization
involving: a) annexation of the territory described as
"Lincoln Acres" to the City of National City; b) detachment
of such territory from the Spring Valley Sanitation District;
c) dissolution of the Lower Sweetwater Fire Protection
District be confirmed subject to the terms and conditions
specified in such order?"
4. The vote required for confirmation of the reorganization
shall be a majority of votes cast in favor of the
reorganization within the boundaries of the "Lincoln Acres
Reorganization," as described in Exhibit A, pursuant to
Government Code Section 56440.
5. The City Clerk shall cause a Notice of Election to be
published in The National City Star News and The San Diego
Union. Said Notice shall be given in substantially the
following form:.
NOTICE OF RLFCTION
LINCOLN ACRES REORGANIZATION
NOTICE IS HEREBY GIVEN that the City Council of the City of National City
has called an election to be held within the territory contained within the
Lincoln Acres area on November 4, 1986, for the purpose of submitting to
the voters within the territory the question of confirmation of the
"Lincoln Acres Reorganization" including annexation of the area to the City
of National City. Such order is on file with the City Clerk of the City of
National City.
At said election the ballots which the voters shall be required to cast
shall contain the following question:
"Shall the order adopted on May 27, 1986, by the City Council of
the City of National City ordering a reorganization involving: a)
annexation of the territory described as "Lincoln Acres" to the
City of National City; b) detachment of such territory from the
Spring Valley Sanitation District; c) dissolution of the Lower
Sweetwater Fire Protection District be confirmed subject to the
terms and conditions specified in such order?"

BE IT FURTHER RESOLVED AND ORDERED AS FOLLOWS:
1. This shall be a resident -voter election.
2. The preparation of an impartial analysis of the proposed
reorganization, the filing of written arguments for or
against the proposed reorganization and the preparation and
mailing of a ballot pamphlet shall conform with Government
Code Section 56119 through 56122.
3. The City Clerk is directed to transmit one certified copy of
this resolution to the Executive Officer of LAFCO within five
days of its adoption.
4. The Registrar of Voters shall render all necessary and
appropriate services in connection with the holding and
conducting of this election, including preparation of the
ballot pamphlet.
5. The campaign disclosure provisions of the Political Reform
Act of 1974, as amended (Chapter 4, commencing with Section
84000 of Title 9 of the Government Code) shall be applicable
to this election.
6. Pursuant to Government Code Section 56443, after the canvass
of the returns of the election upon the question of
reorganization, the City Council shall adopt a resolution
doing either of the following:
a. Confirming the order of reorganization where such
question was favored by a majority of votes cast thereon
within the entire territory within which said election
was held; or
b. Determining the order of reorganization defeated by
failure to receive the required vote.
7. The City Clerk shall immediately transmit a copy of this
resolution to the Registrar of Voters of the County of San
Diego.

All that territory in the County of San Diego, State of California,
lying within the following described boundaries:
Beginning at the northeast corner of Quarter Section 127 of
Rancho de La Nacion, according to Map thereof No. 166, filed in
the County Recorder's Office of San Diego County, May 11, 1869;
1. Thence westerly along the northerly line of said quarter section
to a point distant thereon 140.51 feet easterly .of the easterly
line of Prospect Street, as said street is shown on Lincoln

APPROVED TERMS AND CONDITIONS
LINCOLN ACRES REORGANIZATION (CITY OF NATIONAL CITY)
1. The effective date of the Lincoln Acres Reorganization
(City of National City) shall be the date of recordation
(Government Code Sections 56470[p] and 56456). Upon and
after that date:
(a) Title and responsibility for all County -owned real
property (Community Center/Library and Lincoln Acres
Park) shall be transferred to and vested in the City
of National City (Government Code Section 56470).
(b) The offices of the Board of Directors of the Lower
Sweetwater Fire Protection District shall be terminated
(Government Code Section 56470[1]).
(c) The City of National City shall be the successor to
the Lower Sweetwater Fire Protection District for
the purpose of succeeding to all the rights, duties,
and obligations of the extinguished district with
respect to implied or expressed contracts and obligations
of the Lower Sweetwater Fire Protection District (Govern-
ment Code Section 56472[m]).
(d) All property, whether real or personal, including
all monies or funds (including cash on hand and monies
due but uncollected) of the Lower Sweetwater Fire
Protection District shall be transferred to and vested
in the City of National City (Government Code Sections
56470[h] and [i]).
(e) The district employee will be integrated into the
National City Fire Department at the existing salary
- and rank held during the period that contractual protection
was furnished. All prior service and benefits accrued
prior to and during the contractual protection shall
be retained by the district employee. (Agreement
for continued fire protection and emergency medical
service for the Lower Sweetwater area; dated December 13,
1984) (Government Code Section 56470[1]).
