HomeMy WebLinkAboutCC RESO 14,523RESOLUTION NO. 14,523 RESOLUTION DECLARING ITS INTENTION TO PARTICIPATE IN THE RECREATION PLAN OF THE CORPS OF ENGINEERS SWEETWATER RIVER FLOOD CONTROL CHANNEL PROJECT, INCLUDING BEACH PARK The City Council of the City of National City, California does hereby resolve as follows: WHEREAS, the United States Government had, under authority of Public Law 90-483, approved August 13, 1968, undertaken design and construction of a flood control project in San Diego County, California, known as the Sweetwater River Flood Control Channel, Bonita Mesa Road to San Diego Bay, hereinafter referred to as "Project'; and WHEREAS, recreation was added as a Project purpose by a letter report to Congress; and WHEREAS, on April 20, 1965, the County of San Diego adopted Resolution no. 60 agreeing to act as the sponsoring agency representing local interests, including the City of National City, in giving the assurances of cooperation required by the United States Government in support of the "Project" and the assumption of certain designated obligations including the provision of necessary recreation land and cash contributions, which when added to the land cost, will equal fifty percent (50%) of the recreation first cost and to make all recreation facilities open to all on equal terms; and WHEREAS, the General Design Memorandum, prepared by the U.S. Army Corps of Engineers in March, 1982, contains an overall recreational facilities plan indicating bicycle and equestrian trail, an equestrian rest area, and a beach park within the City of National City's jurisdiction; and WHEREAS, the U.S. Army Corps of Engineers has requested the County as local sponsor to provide an updated letter of intent and resolution to participate in the overall recreational plan; and WHEREAS, the County of San Diego has requested that the City of National City provide them with a letter of intent and a resolution indicating the City's interest in participating in the overall recreation plan; and WHEREAS, the City Council considered the recreational plan including the recreational trail system, the equestrian rest area, and a beach park at meetings held on September 18, 1984 and December 18, 1984. NOW, THEREFORE, BE IT RESOLVED that the City Council hereby pea We declares its intention of participating in the recreational trails system and a beach park subject to the following conditions: 1. The City shall have the authority to approve the ultimate Project costs and the distribution of said costs; 2. The final design and engineering plan shall be prepared as part of the Corps of Engineers Feature Design Memorandum for which the City will have the opportunity to provide design input and to maintain the authority for approval of the final design. 3. The City reserves the right to unilaterally withdraw from participation in the project without cost to the City at any time prior to execution of a cost sharing agreement. 4. The City of National City will not be responsible for preparation of said plans. BE IT FURTHER RESOLVED that the City Council will not participate in the construction, maintenance and operation costs for an equestrian rest area as shown in the Corps of Engineers recreational facilities plan since this rest area is proposed to be located on the south side of the flood control channel and would not serve residents of the City of National City.
