HomeMy WebLinkAboutCC RESO 14,555RESOLUTION NO. 14,555 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, DENYING AN APPLICATION FOR CONDITIONAL USE PERMIT TO ALLOW THE SALE OF DISTILLED SPIRITS ON PROPERTY LOCATED AT 2540 EAST 18TH STREET (APPLICANT: SABAH T. MANSOUR) CASE FILE NO. CUP-1984-31 The City Council of the City of National City, California, does hereby find, determine, order, and resolve as follows: WHEREAS, at a regular meeting of the Planning Commission of the City of National City, California, held on January 21, 1985, said commission adopted Resolution No. 2-85, denying application for conditional use permit to add the sale of distilled spirits as an incidental use to an existing market which presently sells beer and wine on property located at 2540 East 18th Street, based on a finding that the proposed use will have an adverse effect upon adjacent and abutting properties; and, WHEREAS, an appeal of Planning Commission decision was filed with the City Council and a public hearing on appeal was conducted by the City Council; and, WHEREAS, evidence and testimony presented to the City Council at the meeting of February 19, 1985, failed to support a finding that the proposed use will not have an adverse effect upon adjacent or abutting properties. NOW, THEREFORE, BE IT RESOLVED that this application for conditional use permit (CUP-1984-31) is denied for the reason that: the proposed use will have an adverse effect upon adjacent or abutting properties. PASSED and ADOPTED this 26th day of February, 1985. ATTEST: CITY CLERK '
