RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY , CALIFORNIA, APPROVING AN
APPLICATION FOR CONDITIONAL USE PERMIT TO ALLOW
THE SALE OF BEER AND WINE AS AN INCIDENTAL USE
TO A BONAFIDE PUBLIC EATING PLACE ON PROPERTY
LOCATED AT 1231 HIGHLAND AVENUE
(APPLICANT: HSIU LAN CHOU)
CASE FILE NO. CUP-1984-34
The City Council of the City of National City, California, does hereby
find, determine, order, and resolve as follows:
WHEREAS, at a regular meeting of the Planning Commission of the
City of National City, California, held on January 21, 1985, said commission
adopted Resolution No. 5-85, approving application for conditional use permit to
allow the sale of beer and wine as an incidental use to a bonafide public eating
place on property located at 1231 Highland Avenue subject to certain conditions
of approval; and
WHEREAS, an appeal of Planning Commission decision was filed with
the City Council and a public hearing on appeal was conducted by the City
Council; and
WHEREAS, evidence and testimony presented to the City Council at
the meeting of March 12, 1985, support the following findings:
1. The site for the proposed use is adequate in size and shape;
2. That the site has sufficient access to streets;
3. That the proposed use will not have an adverse effect upon
adjacent or abutting properties;
4. That the proposed use is deemed essential and desirable to the
public convenience and welfare.

NOW, THEREFORE, BE IT RESOLVED that this conditional use permit
is approved subject to the following conditions:
1. That no live entertainment be maintained or otherwise permitted
to perform in or upon the premises.
2. That no pool tables be installed or maintained on the premises.
3. That the total annual sales of alcoholic beverages may not
exceed the total annual sales of food products.
4. That on Sunday through Thursday of each week, the hours of
operation for the sale and/or consumption of alcoholic beverages
shall be restricted to the hours between 6:00 a.m. and 11:00 p.m.
5. Before this conditional use permit shall become effective, the
applicant shall file a written statement with the Planning
Department, acknowledging and accepting all conditions imposed
upon the approval of this permit.
PASSED and ADOPTED this 19th day of March, 1985.
