HomeMy WebLinkAboutCC RESO 14,583RESOLUTION NO. 14,583 RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF NATIONAL CITY AND MCDONALD's CORPORATION FOR INSTALLATION OF A TRAFFIC SIGNAL AT THE INTERSECTION OF PLAZA BOULEVARD AND GROVE STREET BE IT RESOLVED by the City Council of the City of National City, California, that the Mayor is hereby authorized to execute an Agreement between the City of National City and McDonald's Corporation for the installation of a traffic signal at the intersection of Plaza Boulevard and Grove Street. PASSED and ADOPTED this 26th day of March, 1985. ATTEST: / CITY CLERK AGREEMENT TO INSTALL A TRAFFIC SIGNAL AT INTERSECTION OF PLAZA BOULEVARD AND GROVE STREET This agreement entered into on March 4 , 1985, is between the City of National City and McDonald's Corporation (herein called Developer). RECITAL 1. A traffic study prepared by Federhart & Associates, traffic engineering consultant, has warranted the installation of a traffic signal at this location. 2. The City of National City and the Developer will benefit from this improvement. 3. The City of National City and the Developer mutually desire to cooperate and jointly participate in construction of the aforesaid improvement and desire to specify herein the terms and conditions under which said improvements shall be construed and financed. The Developer agrees to: 1. Pay 30% of the construction cost estimated to be 0.30(70,700) _ $21,210.00. 2. Pay 30% of the design cost which is equal to 0.30(3,820) = $1,146.00. 3. Deposit $22,356.00 with the City Treasurer concurrently with your execution of this agreement. SECTION 2 The City of National City agrees to: Construct the signal according to City of National City Drawing 5669-D as prepared by Willdan Associates and per Regional Specifications for Public Works Construction, 1982 Edition. SECTION 3 1. This agreement can be modified, altered or revised only with the written consent of both parties. 2. This agreement shall terminate upon completion and acceptance of project by both parties. 3. Upon completion of the project, the exact construction cost will be available, and McDonald's Corporation will be assessed 30% of this cost.
