RESOLUTION NO. 14,584
RESOLUTION ACCEPTING COVENANT AND DEFERRAL
OF STREET IMPROVEMENT AT 913-30TH STREET
(HOGAN)
BE IT RESOLVED by the City Council of the City of National City
that the application of Malcolm and Constance Hogan for deferral of the
installation of improvements at 913-30th Street is granted subject to the
following conditions:
The filing with the Engineering Department of the City of National
City a Covenant Running with the Land recorded by the City Clerk of the City
of National City, providing:
1. The owner will not protest the installation of any of the required
improvements under 1911 Improvement Act program whether
initiated by the property owners or the City.
2. The owner will install said improvements in conjunction with an
overall improvement program of the area whether initiated by
the property owners or the City.
3. The owner will install the required improvement within 30 (thirty)
days of a written demand to do so by the City Engineer.
PASSED and ADOPTED this 2nd day of April, 1985.

COVENANT RUNNING WITH THE LAND
This COVENANT is made by Malcolm Hogan & Constance Hen hereinafter
referred to as "OWNER". WHEREAS OWNER is the owner of the that certain real property locatec
in the City of National City, County of San Diego, State of California, described as follows:
Lot 5, Block 2 Irving Place according to Map # 1522 filed in office of County
Recorder San Diego County January 23, 1913. (A.P.# 563-122-11 '
WHEREAS, said owner desires to be excused from the legal requirements to install the
(,.,llowing improvements: At 913 E. 30th Street:
1. Install 50 lineal feet of Portland Cement concrete standard gutter.
2. Install 1000 square feet of (4") asphalt paving over (10") base.
3. 1000 square feet of seal and sand over asphalt paving.
4. Excavation and grading associated with the above.
NOW, THEREFORE, in consideration for the granting of a deferral to install said improve-
ments by the City Council of the City of National City, said owner covenants for
themselves and their
heirs, successors, assigns, executors and
administrators as follows:
1. The owner will not protest the installation of any of the required improvements undE
1911 Improvement Act program whether initiated by the property owners or the City.
2. The owner will install said improvements in conjunction with an overall improvement
prccram of the area whether initiated by the property owners or the City.
3. The owner will install the required improvements within 30 (Thirty) days of a writtE
demand to do so by the City Engineer.
