HomeMy WebLinkAboutCC RESO 14,599RESOLUTION NO. 14,599 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA AUTHORIZING AND APPROVING A PRELIMINARY APPLICATION TO THE CALIFORNIA DEPARTMENT OF COMMERCE FOR AN ENTERPRISE ZONE WHEREAS, the City of National City, California is eligible to apply to the California Department of Commerce for an Enterprise Zone; and WHEREAS, such Enterprise Zone would provide mechanisms to stimulate private investment, business and industrial growth, and increased employment opportunities within the City of National City; and WHEREAS, the City of National City and the Community Development Commission of the City of National City have, particularly since 1969, engaged in projects and programs designed to stimulate private investment, business and industrial growth, and increased employment opportunities within the City of National City; and WHEREAS, the Executive Director of the Community Development Commission has prepared a preliminary application for an Enterprise Zone which is consistent with and supportive of the purposes of the National City Downtown Redevelopment Project; and WHEREAS, the City Council has reviewed the preliminary application for an Enterprise Zone and understands it. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City, California as follows: (1) The area within the Enterprise Zone application area is a depressed area. (2) Designation of said area as an Enterprise Zone is necessary in order to assist in attracting private sector investment to the application area. (3) The application area is entirely within the National City Downtown Redevelopment Project area as shown in the preliminary application. (4) The Enterprise Zone application area is and shall be the land area contained within the following described area: Beginning at the point of intersection of the northerly City Limit Line with the easterly right of way line of Interstate Highway 5 as said lines are described at pages 1 through 4 and shown in Exhibit 1 in the Redevelopment Plan for the National City Downtown Redevelopment Project recorded December 4, 1981, Official Records, San Diego County, California, File Page No. 81-381665; and thence easterly along said northerly City Limit Line to its intersection with the easterly right of way line of Palm Avenue; and thence southerly along said easterly right of way line of Palm Avenue to its intersection with the southerly right of way line of 18th Street; and thence westerly along said southerly right of way line of 18th Street to its intersection with the easterly right of way line of "B" Avenue; and thence southerly along said easterly right of way line of "B" Avenue to the southerly City Limit Line; and thence southerly along said City Limit Line 330 feet; and thence westerly along said City Limit Line 600 feet to the easterly right of way line of National City Blvd.; and thence southerly 550 feet along said easterly line of National City Blvd. to the northerly right of way line of State Highway 54; and thence westerly 2,000 feet along said northerly right of way line of State Highway 54 to the easterly right of way line of Interstate Highway 5; and thence northerly along said easterly right of way line of Interstate Highway 5 to the point of beginning. Said area contains 1,251 acres. Parcels of land, if any, not located entirely within the above described area are not part of the Enterprise Zone area. (5) The following local incentives to stimulate private investment, the growth of business and industry, and to increase employment within the Enterprise Zone application area, which is wholly within the National City Downtown Redevelopment Project, are hereby approved: (a) Acquisition by the Community Development Commission of real property, relocation of occupants, demolition and site clearance, construction of public improvements and resale of land to private redevelopers on a discounted basis as necessary to obtain new private redevelopment pursuant to the adopted Redevelopment Plan for the Project. (b) Obtaining of HUD 312 loans by the Community Development Commission for the rehabilitation of commercial, industrial and institutional buildings. (c) Construction by the Community Development Commission of 150 units of housing for seniors and handicapped persons, 120 of which shall be for persons of low and moderate income. (d) Home improvement loans and related public improvements by the Community Development Commission pursuant to the adopted program and policies of the Community Development Commission which allocate such loans primarily to persons of low and moderate income. (e) Section 8 housing assistance payments by the Community Development Commission to tenants of low and moderate income pursuant to the HUD Section 8 Housing Assistance Payments Program. (f) Public works improvements by the Community Development Commission utilizing real property tax increments or the proceeds of bond issues which are supported by the pledge of such real property tax increments pursuant to the adopted Redevelopment Plan for the Project. (g) The City shall allocate a fair share of City General Funds, General Revenue Sharing Funds and Community Development Block Grant Program Funds to public works improvements, public services and public buildings and public facilities within the Enterprise Zone area. (h) The City shall waive for two years business license fees for new businesses or industries established within the Enterprise Zone area. (This refers to new businesses, not transfers of existing business to new owners.) (i) The City shall expedite any and all permits and approvals required by City laws for any business or industry within the Enterprise Zone area. (j) The City shall negotiate promptly, on a case by case basis, relief from set back, landscaping, parking or other land use code requirements for any business or industry within the Enterprise Zone area. (k) The City shall engage, on a case by case basis, in tax exempt financing to assist any business or industry within the Enterprise Zone area. (1) The City shall cooperate fully and on a continuing basis with job placement agencies whether public, private or nonprofit to place local residents, particularly those who are unemployed and disadvantaged, in job opportunities within the Enterprise Zone area. (6) The City Council hereby finds and determines that an environmental impact report is required for the Enterprise Zone application area and that the Environmental Impact Report/Environmental Impact Statement (EIR/EIS) for the National City Downtown Redevelopment Project approved pursuant to City Council Ordinance No. 1762, at Section 17 thereof, adopted December 1, 1981 is adequate and sufficient for use as the Enterprise Zone EIR/EIS in that the Enterprise Zone does not include any specific physical projects or programs which were not addressed in said EIR/EIS, and the Enterprise Zone application area is wholly within the National City Downtown Redevelopment Project boundary; and (7) The City Council has reviewed the preliminary application for an Enterprise Zone and said preliminary application is hereby approved and authorized to be filed with the Department of Commerce, State of California. (8) The Community Development Commission of the City of National City, California is hereby designated, pursuant to Section 34112 of the California Community Redevelopment Law, to be the local public agency which shall administer the Enterprise Zone, if approved by the California Department of Commerce, and the Executive Director of the Community Development Commission is hereby authorized and directed to provide any and all information and communication which may be required in connection with the preliminary application and final application for such Enterprise Zone.
