RESOLUTION NO. 14,622
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY, CALIFORNIA, APPROVING AN APPLICATION
FOR CONDITIONAL USE PERMIT TO ALLOW THE OPERATION OF A
PAWN SHOP ON PROPERTY LOCATED AT 139 EAST EIGHTH STREET
(DAVID M. SIMON - CUP 1985-2)
The City Council of the City of National City, California, does
hereby find, determine, order, and resolve as follows:
WHEREAS, at a regular meeting of the Planning Commission of the
City of National City, California, held on April 1, 1985, said commission
adopted Resolution No. 14-85, denying application for conditional use permit to
allow the operation of a pawn shop on property located at 139 East Eighth
Street; and
WHEREAS, an appeal of Planning Commission decision was filed with
the City Council and a public hearing on appeal was conducted by the City
Council; and
WHEREAS, evidence and testimony presented to the City Council at
the meeting of May 7, 1985, support the following findings:
a) The site for the proposed use is adequate in size and shape.
b) That the site has sufficient access to streets.
c) That the proposed use will not have an adverse effect upon
adjacent or abutting properties.
d) That the proposed use is deemed essential and desirable to
the public convenience and welfare.
NOW, THEREFORE, BE IT RESOLVED that this conditional use
permit is approved subject to the following conditions:
1. This business shall be conducted in accordance with
Chapter 6.54 of the National City Municipal Code.
2. At least one fire extinguisher, Type 2A:10BC shall be pro-
vided.
3. Exiting shall be in accordance with the Uniform Building
Code.
4. No flammable materials, hazardous materials or explosives
shall be stored, handled or sold without approval and
permit from the Fire Department.
5. Parkway on "B" Avenue shall be landscaped with a com-
bination of turf and trees and provided with a permanent
underground irrigation system. Planning Department
approval of a detailed landscape/irrigation plan re-
quired prior to installation.
6. A masonary trash receptacle enclosure shall be constructed
in accordance with City standards at a location to be
approved by the Planning Department.
7. Before this conditional use permit shall become effective,
the applicant shall file a written statement with the
Planning Department, acknowledging and accepting all
conditions imposed upon the approval of this permit.
8. The conditional use permit shall be subject to revocation
if any interest in the business conducted on the premises
becomes owned by an individual whose criminal history
indicates a violation of state or local laws regulating
pawn shops or second hand stores, or whose background
indicates a failure to cooperate with enforcement agencies
charged with enforcing these laws.
9. The conditional use permit shall be subject to revocation
upon the recommendation of the Police Department, if the
operator is found to be in violation of state or local
laws regulating pawn shops or second hand stores.
