HomeMy WebLinkAboutCC RESO 14,630RESOLUTION NO. 14,630 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, CERTIFYING A FINAL ENVIRONMENTAL IMPACT REPORT FOR A GENERAL PLAN AMENDMENT, PREZONE AND ANNEXATION OF PROPERTY LOCATED ADJACENT TO THE EASTERLY BOUNDARY OF THE CITY OF NATIONAL CITY IN THE SWEETWATER VALLEY AREA, ON THE SOUTH SIDE OF STATE ROUTE 54, NORTH OF LOMACITAS LANE ALONG VALLEY ROAD, WEST OF THE JUNCTION OF AVENIDA SAN MIGUEL. (APPLICANT: VALLEY LAND COMPANY) WHEREAS, the Local Agency Formation Commission (LAFCO) is currently reviewing a request for annexation of the property located adjacent to the easterly boundary of the City of National City in the Sweetwater Valley Area, on the south side of State Route 54, north of Lomacitas Lane along Valley Road, west of the junction of Avenida San Miguel; and WHEREAS a Draft Environmental Impact Report (DEIR) was prepared in accordance with the California Environmental Quality Act (CEQA) Law and Guidelines and the National City Procedures for Environmental Review; and WHEREAS a public notice of the availability of the DEIR, designating a 30-day public review period ending on April 21, 1985, was provided in accordance with Section 21092 of the Public Resources Code of the State of California; and WHEREAS, on May 20, 1985, the Planning Commission held a duly noticed public hearing and considered the DEIR, at which time staff reported on the written comments, raising significant environmental points received from the persons, organizations, and public agencies listed on the DEIR distribution list and the responses given thereto; and WHEREAS, the Planning Commission heard public testimony on the DEIR at their meeting of May 20, 1985, and adequately addressed such testimony; and WHEREAS, the Planning Commission after considering the DEIR and all pertinent information voted at their May 20, 1985 meeting to adopt a resolution recommending that the City Council certify the EIR as adequate and complete; WHEREAS, the City Council at their meeting of May 28, 1985 considered the recommendation of the Planning Commission and the Planning Department; and Page two WHEREAS, the DEIR identified certain significant environmental impacts requiring mitigation at the development stage; NOW, THEREFORE, BE IT RESOLVED, that the DEIR, together with the distribution list for all persons, organizations, and public agencies receiving copies of the DEIR, is hereby certified by the City Council as complying with the requirements of CEQA Law and Guidelines and is hereby adopted as the Final Environmental Impact Report (EIR) for this project. BE IT FURTHER RESOLVED that the City Council does hereby find as follows: 1. Changes or alterations have been required in, or incorporated into, the proposed project which mitigate or avoid the significant environmental effects thereof as identified in the final EIR. The environmental impacts and mitigation measures specified are included in the final EIR and summarized in the Planning Department's Staff Report. Mitigation measures specified in the above will be required as conditions of approval at the time of development. 2. Certain changes or alterations are within the responsibility and jurisdiction of another public agency and not the City. Such changes will be adopted by the other agency. The environmental impact under the jurisdiction of another agency and its mitigation is included in the final EIR and summarized in the Planning Department's Staff Report.
