HomeMy WebLinkAboutCC RESO 14,678r'^ RESOLUTION NO. 14,678 RESOLUTION AUTHORIZING EXECUTION OF A PROPOSED SERVICE AGREEMENT FOR FY '86 BETWEEN THE CITY OF NATIONAL CITY AND SAN DIEGO TRANSIT CORPORATION BE IT RESOLVED, by the City Council of the City of National City, California, that the Mayor is hereby authorized to execute on behalf of the City, an agreement for the operation of Route 29 for fiscal year 1985 - 1986, between the City of National City and San Diego Transit Corporation. Elser, III - City Attorney San DiegoTransit June 6, 1985 Honorable Mayor and Members of the City Council City of National City 1243 National Avenue National City, CA. 92050 Dear Mayor and Council Members: Attached is a copy of the proposed FY86 service contract between the City of National City and San Diego Transit Corpo- ration. In order to meet the TDA filing deadline, this contract as usual is based on our preliminary budget. Should there be any change in our FY86 budget a "First Amendment" to this contract will be developed for your approval. The most significant change from the FY85 contract is the estimated level of federal operating subsidy. Based on the most current information available, this contract estimates a fifty percent decrease in available subsidy. If the actual amount of subsidy received has a significant impact on San Diego Transit's FY86 budget, a First Amendment will neces- sarily be developed. Other significant changes from the FY85 contract are as follows: o Increase in projected revenue passengers. Decrease in gross cost per mile from $3.6755 to $3.6188. • Decrease in STA subsidy from $.0777 to $.0218 per passenger. • Increase in capital cost per mile from $.0199 to $.1273. • Increase in total TDA claim from $0 to $18,650. Because of the impending acquisition of San Diego Transit by the Metropolitan Transit Development Board, there is a new element in the FY86 funding of SDT service. If the acqui- sition does occur on July 1, 1985, SDT will not claim FY86 TDA City of National City Page two June 6, 1985 funds directly from National City, and therefore, a service contract between National City and SDT will not be necessary. Instead, MTDB will claim a Regional Transit Service Assessment to provide for the operation of Route 29 in National City. We anticipate that this will be the case. However, we request approval of the attached service contract contingent upon the acquisition not occurring on July 1st. This approval will ensure the continuous provision of SDT service to citizens of National City with or without transit reorganization. Murphy Director of Operations RAM:JCB:mm Attachments City of National City FY86 AGREEMENT This agreement is entered into by and between SAN DIEGO TRANSIT CORPORATION, hereinafter called "Corporation", and the CITY OF NATIONAL CITY, hereinafter called "City" in view of the following facts: A. Corporation, pursuant to an agreement with the City of San Diego, operates a mass transportation system involving the City of San Diego and its environs, which includes City. B. Corporation is unable to provide satisfactory and adequate service to the citizens of City without the financial aid of City. C. City recognizes the value of the service provided its citizens and is willing to contract with Corporation to provide transportation service through the areas of City. NOW, THEREFORE, it is mutually agreed between the parties hereto, upon the following terms, covenants and conditions: 1. Corporation agrees to furnish City a system of mass transportation for the benefit of the citizens and visitors of City as may, from time to time, be agreed upon the between the parties, such service to be paid by City to Corporation according to the formula set forth in Exhibit "A" attached hereto and incorporated herein as though set forth in full at this point. 2. Corporation, pursuant to the terms of said formula referred to in the preceding paragraph, shall provide such services to City as may be mutually agreed upon. The parties shall also agree to the following: a. Frequency of service; b. Location of bus stops throughout City; c. Number of hours per 24-hour period service is provided City; d. Routes the vehicles of Corporation shall travel through the streets of City; e. City recognizes that Corporation has certain obligations under the labor agreement with Corporation employees. Therefore, City agrees that in requesting cancellation of service, major routing changes or major schedule changes, notice will be given on or before July 1, November 1, or April 1, so that such changes can become effective within ninety (90) days following these dates. This will allow Corporation time to comply with the pertinent clauses of Corporation's labor agreement. It is further agreed that Corporation, when requested by City, will make minor route changes, minor schedule changes or implement totally new service (i.e., Express service, Shuttle service, Through service) at any time, limited only by the time it takes to write the schedule and physically install the bus stops, as long as Corporation would not be in violation of the labor agreement with Corporation employees; and f. Recognizing public convenience and safety, Corporation agrees, upon request by City, to install, relocate or remove bus stops as soon as possible, upon mutual agreement of City and Corporation staff, who are charged with this responsibility. 3. If Corporation is unable to provide service as designated in this agreement, Corporation may cancel all or parts of the service upon ninety (90) days written notice to City, and City's Local Transportation Fund shall receive reimbursement on contracted amount based upon net costs and route miles contained in this agreement. 4. This agreement shall be binding upon the parties hereto, their successors and assigns, and shall continue in effect from July 1, 1985 to June 30, 1986. New contract terms will be negotiated each year prior to July 1st. 5. If the Metropolitan Transit Development Board acquires San Diego Transit on July 1, 1985, this contract shall be null and void.
