A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY, CALIFORNIA, APPROVING
AN APPLICATION FOR CONDITIONAL USE PERMIT
TO ALLOW OPERATION OF A COMMERCIAL PRINTING
AND PHOTOCOPYING BUSINESS
ON PROPERTY LOCATED AT 710 EAST THIRD STREET
(APPLICANT - HERMAN BACA) (CASE FILE NO. CUP1985-6)
The City Council of the City of National City, California,
does hereby find, determine, order, and resolve as follows:
WHEREAS, at a regular meeting of the Planning Commission
of the City of National City, California, held on May 20, 1985, said
Commission adopted Resolution No. 21-85, approving an application
for a conditional use permit to allow operation of a commercial
printing and photocopying business on property located at 710 East
Third Avenue subject to certain conditions of approval; and
WHEREAS, an appeal of Planning Commission decision was
filed with the City Council and a public hearing on appeal was
conducted by the City Council; and,
WHEREAS, evidence and testimony presented to the City
Council at the meeting of July 9, 1985, support the following
findings:
1. The site for the proposed use is adequate in size
and shape.
2. That the proposed site has sufficient access to streets.
3. That the proposed use will not have an adverse effect
upon adjacent or abutting properties.
4. That the proposed use is deemed essential and desirable
to the public convenience and welfare.
NOW, THEREFORE, BE IT RESOLVED THAT THIS conditional use
permit is approved subject to the following conditions:
1. Prior to issuance of a Certificate of Occupancy, the
owner of the land on which the parking facilities are
provided shall record a parking agreement, approved
by the City Attorney as to form and content, in the
office of the County Recorder as a covenant running
with the land for the benefit of the City. The agree-
ment shall be continued so long as the use it is
intended to serve is continued.
2. A masonry trash receptacle enclosure shall be constructed
in accordance with City standards for a commercial
enclosure, at a location to be approved by the Planning
Department.
3. Four (4) parking spaces shall be marked and provided
with wheel stops in accordance with Chapter 18.58 of
the Land Use Code. The chuckhole in the access drive
shall be repaired.
4. Existing olive tree located within the parkway on
Third Street shall be removed by City forces and
replaced after $15.00 payment by the applicant; and,
the applicant shall remove 27 feet of existing damaged
curb and replace with 6-inch curb per standard Drawing
G-1
5. All flammable inks, etc., shall be stored in accordance
with the Uniform Fire Code.
6. A Building Permit is required for all tenant improvements.
7. Before this permit shall become effective, the applicant
shall file a written statement with the Planning Depart-
ment acknowledging and accepting all conditions imposed
upon the approval of this permit.
8. Landscaped yard areas on Third Street and "G" Avenue
shall be weeded and restored.
9. Plywood panels over front window of building shall be
removed prior to issuance of a certificate of occupancy.
