HomeMy WebLinkAboutCC RESO 14,717RESOLUTION NO. 14,717 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, DENYING AN APPLICATION FOR CONDITIONAL USE PERMIT TO ALLOW THE SALE OF BEER AND WINE (TYPE 20 LIQUOR LICENSE) AS AN INCIDENTAL USE TO A CONVENIENCE MARKET ON PROPERTY LOCATED AT 1835 HIGHLAND AVENUE - - (APPLICANT: MIKE DAMI) CASE FILE NO. CUP-1985-13 The City Council of the City of National City, California, does hereby find, determine, order, and resolve as follows: WHEREAS, at a regular meeting of the Planning Commission of the City of National City, California, held on July 1, 1985, said commission adopted Resolution No. 29-85, denying application for Conditional Use permit to allow the sale of beer and wine as an incidental use to a convenience market on property located at 1835 Highland Avenue based on a finding that the proposed use would have an adverse effect upon adjacent and abutting properties; and, the proposed use is not deemed essential and desirable to the public convenience and welfare and, WHEREAS, an appeal of Planning Commission decision was filed with the City Council and a public hearing on appeal was conducted by the City Council; and, WHEREAS, evidence and testimony presented to the City Council at the meetings of July 23 and August 6, 1985, support the following findings: 1. The proposed site is bounded to the north by Der Wienerschnitzel take- out restaurant. It can be expected that customers from this restaurant will consume alcoholilc beverages obtained from the subject premises due to its accessibility. 2. Within 500 feet of the subject premises there are two (2) business establishments that offer alcoholic beverages as an incidental use, and one (1) establishment that offers alcoholic beverages an a principal use. 3. The National City Police Department has strongly protested the issuance of a conditional use permit to sell beer and wine at this location. This protest is based upon problems which have had significant impact on police service in the past, and the fact that the area is still the object of continued necessary extra patrol and surveillance. 4. The proposed use will have an adverse effect upon adjacent and abutting properties. 5. The proposed use is not deemed essential and desirable to the public convenience and welfare at this location. NOW, THEREFORE, BE IT RESOLVED that this application for conditional use permit is denied for the reason that: The proposed use will have an adverse effect upon adjacent and abutting properties; and, The proposed use is not deemed essential and desirable to the public convenience and welfare.
